Pregnant, Islamic Marriage & Living together

Post by HappyHappy » Wed Sep 02, 2015 4:23 pm

Hi there,

Apologies if this has been posted before - there is a wealth of knowledge here and I can't seem to find the answer to my question. I'd be grateful for any advice and I'll try and keep this short.

I'm a British Citizen
I have done an Islamic Nikah with my husband Oct 2014 (appreciate this is not seen as a recognised form of marriage in the UK)
We have been living together since and I have proof of utility bills with both our names
I'm now almost 4 months pregnant
I have evidence of our marriage, such as wedding video, pictures, proof of our relationship when it began including witnesses we can call on and finally the Nikah contract that we both signed.
I currently work full time

In order for my husband to gain citizenship are their any viable recommended next steps that you would recommend?

What routes would avoid him going back to his home country.

Should we wait till the birth of our child?

In terms of registering the baby, once he/she is born - I assume it would be a stronger case to register the baby with the father's surname? I ask as I recognise our marriage is not legally recognised by UK law.

Any advice and next steps would be greatly appreciated.

Best wishes,

*HH*

What is your husband's current immigration status and history??

Citizenship takes a few years, there are steps that come before that.

Also, when replying to CR001's post, it would help if you could also say why you haven't married formally under British law in a designated Registry office? (in addition to the religious ceremony)
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Is either person in the marriage currently also married to/in a legally recognised partnership with another person?

Dear all,

Many thanks for your responses.

Here are the answers to your questions.

We have not married under British Law as my Husband overstayed, therefore has no legal status here.
He has been here since 2009 (I think) sorry not great with dates.
Secret.Simon - not sure if I've understood correctly - but I hope this answers your question: Neither of us are married to anyone else.

Thanking you in advance
