Tier 2 General Multiple Questions

Hello All,

Would be of great help, if you could please help me with a few questions.

1. I am currently on Tier 2 General 5 year visa from July 2014.
I am looking to change employer and would like to know, if its possible for me to opt for 3 year Visa or should i still opt for 5 year visa, ( provided if employer is ready to provide COS for 5 years )?
Reason is, difference in cost and employer most likely will stick to 3 year visa.
Want to confirm, if moving from 5 year to 3 year was fine and acceptable.

2. In case, if i get a 5 year visa.
can my dependents opt for a 3 year visa or will they still have to opt for the same duration as my visa ?

3. I am planning to Opt for same day - premium service, just for me.
Would it be fine to process my dependents visa via post after i have attained my visa through the same day - premium service ?

1. yes you can move to 3 year. Visa will be granted based on COS dates.

2. Dependent leave will be granted in line with main applicant so if you get 5 years, likely dep will get 5 years.

3. Yes you can do yours in person and dependants by post. Do they have current valid visas and if so, when do they expire?

for point 3. Yes, my wife and 1st child have BRP Valid from Jan- 2015 to Aug -2019


Though there is about 4 years of validity left on mine and my dependents, i assume , me changing my employer will invariably require reprocessing by dependents visa / brp as well right ?

I stand corrected (Manci or Sushdmehta can confirm) but your dependants don't need to apply as they have valid PBS Dependant visas.

You have helped me save a fortune.

Once i process my visa under the new sponsor, my new visa validity (likely, as i am yet to do) will be
Approx : Oct - 2015 to Oct 2018

However, my dependent's current BRP is already valid till August- 2019
I assume, it will not be a problem, as long as i extend my visa by Oct 2018, right ?

Do note that irrespective of the expiry date shown on the BRP, a dependant's right to stay in UK depends on whether the principal migrant is allowed to stay in the UK.

So, if for some reason you do not stay in UK beyond the validity of your new leave (e.g. ket's say Aug 2018) , your dependant(s) will have no right to stay either - despite their leave ending in Aug 2019.

Many Thanks for clarifying the below point.
Yes, i do understand that, at any point, when my(primary applicant) rights to live in UK expires, automatically all my dependents rights get expired at the the same time.

Both of you have been extremely helpful and saved me from unwanted spending on 2 Visa application fees and 2 NHS surcharges.

I have got my New COS from the new sponsor, but for some reason, they have sent me only the first page of the COS, it has details only upto my UK NI number details.
Details such as start date / end date / Job type code are on the second page of COS and without which i cannot start my application i guess :(

Hello,

I am currently filling in the the Tier 2 General application form and have completed till the point of making
NHS surcharge payment and Visa fee payment.

This is the first time i am filling in a Tier 2 General ( in country ) application for a Unrestricted COS.
I need help to ensure that i am using the right forms.

The online application i am using is accessed from :

Use the " Apply Now" button.

1. My Partially completed application reads : Tier 2 (General) Leave to remain.
Can you please confirm if this is the right category please.

2. My Job title is asked but NOT Job code , is that fine please ?

3. Toward the end of the application :
The below is stated - can you please confirm, if i am still using the right forms please .

Information you do not have to provide
- You do not need to prove you meet the required level of English because you have current leave in Tier 2
(General) leave to remain, or had leave in the past

- You do not need to prove maintenance because you have current leave in Tier 2 (General) leave to
remain


Please let me know if you need any more information from me to confirm the correctness.
