Visa Extension for Spouse

Post by jack_daniel » Tue Sep 08, 2015 3:00 pm

Visa Extension for Spouse:-
---------------------------

My Wife came to UK on 18/06/2014 on PBS dependent visa as i was on (Tier2) visa at that time.
She was granted visa till 15/11/2015 as i had my (Tier2) valid till that time.
I got my ILR on 07/10/2014. I didn't got her extended through FLR route as i wasn't keen on her losing time on ILR in future.
Now in two months time she will have to travel abroad in Nov 2015 and her visa is due for renewal as well.

Hence I have the following questions:-

-Is "https://visas-immigration.service.gov.uk/" gov.uk the correct website to applying extension from in country (UK)?
As I guess visa4uk is only for out-of-country Applications.

-If i'm not applying her for FLR then She'll be extended under PBS dependent category?
(As I have already got my ILR 11mnths ago, do i still have to provide my previous CoS and Employment details?)

-What is the earliest i can apply for her extension (PBS Dependent visa expiry - 15/11/2015)

-NHS Health Surcharge ,IHS why to pay that if we are already making the NI Contributions from Salary?

-She has maintained sufficient balance in her account more than 5000£ since last 3 months, Is her bank statements enough to provide financial proof. We have got Council tax , Water Bill together in our name and both of our names are registered in the Electoral Roll.

She can extend at any time on the PBS Dependant form. It is a paper based application.

No you do not need your previous COS.

Yes, she will have to pay the IHS surcharge of £600 (£200 x 3 year visa), regardless of the tax and NI you/she pays.

You need cohabitation documents either in joint names or individual names, from 4 to 6 difference sources.

Thanks very much Char..much appreciated for your response.
Also is there no way of applying online while in country?

While Filling the Form, I have some doubts in the following sections

SECTION M - About your Maintenance

M4:- Has the PBS main applicant received notification that their application has been successful? (ht)
Yes/No

(Should It be Yes ?, as the PBS main Applicant in this case myself had already been successfully granted ILR on Oct 2014)

M5:- Under which category of the Points Based System has the main applicant applied?
Tier 1 (General) - go to M6
Tier 1 (Entrepreneurs) - go to M7
Tier 1 (Graduate Entrepreneur) - go to M10
Tier 1 (Exceptional Talent) - go to Section N
Tier 1 (Investors) - go to Section N
Tier 1 (Post Study Work) - go to M7
Tier 2 (General) - go to M11
Tier 2 (Intra Company Transfers) - go to M11
Tier 2 (Minister of Religion) - go to M11
Tier 2 (Sportsperson) - go to M11
Tier 5 (Temporary Worker) - All categories - go to M11

(Should it be Tier 2 (General) ? - as I had received ILR on Tier 2(General) route.)

SECTION N - About your Personal Circumstances/attributes

N4:- Do you intend to remain in the UK beyond the period of leave that your Spouse/Civil Partner has or may be given?
Yes/No

(Should it be No?, as the Spouse mentioned in this context is me who has already got ILR, so no need to remain beyond that)
Again the ILR is valid till 2024, Hence technically by saying No means she doesn't want to stay after 2024)

N7 to N15 ( Are they only meant to be filled if the Dependent is applying as a born children of Main Applicant and not spouse)

In this case should it be left blank?
Also.

N9:- Have you formed an independent family unit from your parent or are you living an independent life?

(What does Home Office wants to know? here)

many thanks
JD

Hi All,

I'm here in a bit of confusion.
I have used the online portal (https://visas-immigration.service.gov.uk) of gov.uk to apply an extension for PBS dependent visa.
I've paid the IHS fee separately and paid the PBS dependent fee of 651£ too and using that Ref number
i have now successfully filed and submitted the Application for PBS dependent online.

Now there is a pdf version of the PBS dependants form available which is a much more detailed version (35pages) and asks for further details.
https://www.gov.uk/government/uploads/s ... _08-15.pdf

whereas the online version doesn't ask for so much information.
Once submitted at the end it generates a filled Application Form alongwith a checklist form.
I just need to print them and send them alongwith her passport , her photos and financial and residential documents via post.

Am i doing it right or I still need to download , print and fill the 35 page document.
