ICT Tier 2 Apply for ILR

ICT Tier 2 Apply for ILR

Hi All, first time user. I hear a lot of praising for this site. so appreciate any help.

I am on ICT Tier 2 Visa. My wife and kids are my dependants.

I spent 5.5 years in the UK. I didn't apply yet due to issues with extensive travel for work ending with couple days beyond the 180 days for one of the years. Hence ICT Visa extended for another 3 years.

There's a window for me to apply with confirmed issue of the 180 days limit for each year from the date of submitting the application being resolved (all 5 years since that date each year having less than the total 180 days).

I have full file ready for me and my dependants, and of course will gather the bank statements and pay slips for the last 3 months before applying.

Since the company submitted already a COS for me covering next 3 years, It seems I may be applying out of pocket.

My question is what paperwork do I need from my employer? I assume company headed letter supporting my travel. anything else? Do I need a letter stating that I am employed by my company? or the fact that I am on COS for the next 3 years is enough? if that letter is needed, is it just a letter stating I am employed with them or does it need to be a new COS?

Additionally, I am exploring applying for myself first as I need the passport urgently for travel for work. Once done, I would apply for my wife and kids at later stage. no urgency as my understanding is that their dependant visa will stay valid once I am approved.

My question about my dependant is that would they go directly to citizenship application from their dependant Visa once I get my ILR or they must apply for ILR regardless at a point in time before going to citizenship? Is it advised to apply for everyone at once, any concerns/issues/difficulties applying for them separately after applying for myself? looking for budgeting for premium application for myself them dependants later, instead of 4 premium applications at once, cost saving, and avoid any surprises ensuring my application thru then doing the same for them later (same day premium application)

Aware of the April 7th 2010 rule change and not an issue in my case.

your advise is greatly appreciated.

Where were your children born? If they were born abroad, they will need ILR before citizenship and will only qualify for citizenship when you/spouse apply.

If any child dependents were born in the UK, once you have ILR, you can register child(ren) as British citizens on form MN1 under section 1(3) of the nationality act. Born in the UK is an entitlement to register once one of the parents obtains ILR.

You can apply for your ILR first with an in person appointment and for all of your dependents by post if you wish at a later point.

Thanks for your quick reply. much appreciated. Yes children born abroad. so will proceed as advised. Just wanted to confirm is any concerns on additional overhead should I apply for my wife and children later. from your reply I assume the answer is no.

Additionally, would appreciate responding to the question about what paperwork needed from my employer (first question in my post). I am already on renewed ICT Visa for the next 3 years (renewed couple months ago). Does this cover what is needed from the employer? Do I need a separate new COS?

Any additional documents from the employer beside a company headed history of travel?

Look at the ILR application - there is no CoS for ILR!!!

You may want a letter confirming that your role continues to be needed and that you are needed for it.
