Post by aniladam » Fri Sep 18, 2015 10:51 am

Hi, I need some guidance on the list of documnets that are required for my future wife's visa as dependant.

Apply to join family living permanently in the UK.
1Q.
I have completed the application form (disn't submitted though) online on Visa4UK site. Is this the correct options to be selected on Visa4UK site??

Apply for someone else >>

2Q.
Do I have to submit the VAF4A form?
Do I have to submit the VAF4A Appendix1 form?

3Q.

Dear GURUS

I would appreciate if you could resolve my doubt about the query I have.

I have got ILR on 10 years long residency and now applied for Naturalisation ( under process ).

My ILR was granted in Feb'2014 previously was holding Tier 1 Genral (Extension for 3years). I got married in July 2013 and wife came under Tier 1 General dependent Sept 2013 , I didnt bother to change her status as she was holding visa till Feb.2016.

But since i was due to apply for BC i applied her for FLR(M) in August 2015 and got granted visa under ILR dependent for 30months.

The query is :

Will she be able to apply for ILR after this 30 months period or she needs to apply SET(M) and forget about the stay of previous 2 years ( Sept 2013 to August 2015) she has been in the UK ???

Kindly advise.

Thank you

If she had remained as a Tier 1 dependant, your wife would have been eligible for ILR in September 2018.

But when she switched to ILR Dependant, her ILR clock reset to zero and now she can apply for ILR in August 2020. She will also need to apply for another FLR (M) in January 2018.

Thank you for your expert advice...

i am a bit confused... you have mentioned she has to apply for FLR (M) which she has alsready applied and granted a visa for 30months till March 2018...

Do you intend to say SET ~(M) !!!!

As her clock has reset, she will need another Further Leave to Remain -FLR(M)- before her current FLR(M) expires in March 2018.

She can use the Settlement-SET(M)-form when she becomes eligible for ILR (also known as settlement) in August 2020.

Hi Gurus,

I got my ILR in June this year. I would like to file ILR for my wife and kid. I am not sure whether my wife is eligibile for ILR or not. Below are my details and Can anyone advise us please.

I got my Tier 2 General on Jun 2010 and got my ILR on Jun 2015.

I got married on Dec, 2011 and my wife got her Tier 2 visa on Apr 2012 which was valid until Jan 2013. She came to UK in Apr 2012. She has gone back to India for delivery on Sep 2012. Both my wife and my kid got their Tier 2 Visa on Nov 2013. They came to UK and are living in UK till date, As per the dependants eligibility criteria, MY wife got her first Tier 2 Visa on or before 9 Jul 2012. But She had a gap of around 14 months(from Sep 2012 until Nov 2013). Is she eligible for ILR or Do we need to apply for Tier 2 Extension. Please advise.

I think My kid is eligible for ILR. Please confirm

Thanks for your help in advance.

Did your wife get a Tier 2 Dependant visa or did she get a Tier 2 visa in her own right? If the latter, did she get a T2 General or a T2 ICT visa?

It also seems strange that she got a visa for only 9 months. That is very unusual. Can you double-check the dates?
Vamseek wrote:But She had a gap of around 14 months(from Sep 2012 until Nov 2013).
The gap means that the Tier 2 visa issued in November 2013 is not an extension of the older visa issued in April 2012, but a new visa issued under the rules after July 2012. So, assuming that she is on a dependant visa, she will have to apply for an extension and will be eligible for ILR in November 2018.

As your child was born abroad, your child's status will be in-line with the mother's. Had s/he been born in the UK, s/he could have been registered as a British citizen when you got ILR.

She got her Tier 2 dependant visa on all the occasions. She got her visa only for 9 months because my tier 2 general visa was valid only for one year and used to get extended every January for another year. When She got her Visa for the first time in April 2012, she got it until Jan 2013. Second time she got her tier 2 dependant visa in Nov 2013, it was until Jan 2014( Just for 3 months). In Jan 2014, She got her tier 2 dependant Visa until Jan 2016. This was because of the Employer Sponsorship certificates.

I understand.

My advice stands.

Hi

could anyone please help me ?

My husband came to UK on Feb 2011 with Tier1 General visa.
i think he is eligible for ILR in Feb 2016

I got my Tier 1 depedent visa on March 2013 and came to Uk in the year June 2013. My visa expiry date is same as my husband in Feb 2016.

Am i eligible for ILR like my husband in Feb 2016? If not, should I go for any extensions. Which form i need to fill ? how many years will they give the extension??
Can me and my husband go on the same day for visa with the same appointment? I am not clear what should i do. Please help

Can me and my husband go on the same day for visa with the same appointment? I am not clear what should i do. Yes, his appointment first and then yours a couple of hours later.
Please help

Hi Gurus,

I came to UK on Tier 2 General Visa in May 2010 got my ILR in June this year. My wife and Kid came to UK in Nov 2013 on Tier 2 dependant Visa which will expire in Jan 2016. Since they are not eligible for the ILR, I am applying for their extension.

As per the UKBA web site, dependants should apply in the applicant's route category if the applicant is a citizen or Settled in UK. In my case, I have to apply Tier 2 Dependant Visa for both. Is this the right application form? In the online Tier 2 applicaiton form, following fields are mandatory

Applicants Sponsor licence number
Length of CoS

Since I got my ILR and I dont have a valid COS. What should I fill in these fields? I have sent an email with these queries to the applyonline-esupport but I haven't recieved any response so far.

I have entered my current employers licence number and entered Upto 3 years in the length of COS and completed the form but to pay the NHS surcharge IHS website requesting my details such as my Visa Valid until. If I enter ILR valid date 31-12-2024 it is calculated the NHS surcharge as GBP 1800 per person ie., 3600 in total.

When I checked the UKBA website, it is showing NHS surcharge as GBP 200 per person per year.

We are confused on filling the application form and IHS details. Can you please help me.

Regards,
Vamsee.

Hello Gurus/CR001

Could you please help me on this?

My husband is applying for ILR based on 5 years route(tier 1 general with limited company contractor).
He is 50% share holder of the company and I am the rest 50%. So I also get salary & dividends like him.
He is applying for ILR soon but my doubt is whether my husband should show any of my payslips and dividends along with his dividends and payslips as it is 50% share?

In other words, will he or me would require to produce any evidence for my salary and dividends (being just 50% share holder).
also, I am applying as a tier1 dependant. WIll I need to produce these payslips and dividends that is on my name ?

regards
rupa

Vamsee - Can you please share your experience and describe the procedure (which form to use, CoS, etc). I am in a similar situation as you.
