Switching from Tier 2 ICT to Tier 2 General Visa

Hello All Gurus,

Please can you provide your expert advise and give me direction if I can switch from Tier 2 ICT to Tier 2 General if I get an sponsorship

My Visa and stay history
Visa - Work Permit
Start - 24 April 2008 end - 24 April 2010
My Stay in UK - 25 May 2008 till 12 Oct 2009 - 17 Months

Visa - Tier 2 Established Staff
Start - 02 Feb 2011 till 24 Jan 2013
This Visa got cancelled as I didn't Travel to UK

Visa - Tier 2 Long Term Staff Migrant (ICT)
Start - 06 May 2011 till 23 May 2013
My Stay in UK 23 May 2011

I have further extended my Visa and have got 2 extension, now mu current Visa is till 16 May 2016 and I am in UK since 23 May 2011 and my first entry in UK was 25 May 2008

Please can you tell me
1) Can I apply for ILR in May 2016 cnsidering I have spent 5 continuouse year and my first Entry in UK is in 2007
2) Can I switch from my current Tier 2 ICT longterm Visa to Tier 2 General, if Yes then will I be eligible for ILR in May 2016

1. No, because the gap between your WP and your ICT visa is far too long so continuous residence is broken.

2. You can switch to Tier 2 General if you have an approved sponsor. 12 month cooling off period is applicable to you though and you have to apply for Tier 2 G from home country. If you earn above £155k, cooling off likely not to apply to you. Your 5 years for ILR will be reset to zero.

If you had remained on the established staff ICT visa, you would have been able to switch in country.

If I apply for Tier 2 G after an year and stay in country till 2018 or beyond but not full 5 years can I apply for ILR under Long Residence starting from 2008 since I came in UK

No, because your continuous residence has been broken as your earlier absence between WP and ICT is more than 6 months.

1) If I satisfy above condition then for how many years I can get Tier 2 G
2) Also can’t my Tier 2 ICT continuous period used in combination of Tier 2 G to apply ILR in May 2016
3) I am on with Sponserer “A” since May 2011 till Dec 2015 and If I change the sponserer to “B” with above earnings (£155k ) Can I remain on ICT with sponserer “B” and apply for ILR in May 2016, also can my ICT be extended and if yes how long if my earning is as mention above
