Staying for six months with British spouse under tourist vis

Post by giorawr » Thu Oct 22, 2015 4:30 pm

Hello everyone!

I'm hoping someone could help me with my current situation. Here's what's going on: my British husband is about to get a job that satisfies the minimun income requirement but we can't apply for a spouse visa before he has at least 6 payslips, right? So our plan is for me to go to the UK as a tourist for six months and then come back to my country with his paylisps and all the other necessary documments so I can apply for a spouse visa. I'd wait until I got a decision here and then come back to England.

I know I'm allowed to stay in the UK for six months as a tourist, but under these circunstances I'm becoming a little afraid that immigration officers might see it as suspicious.
I'd already have a return date and a return ticket (which is when I'm coming back to apply for the spouse visa) plus an ammount of money and a letter from my husband stating he'd support me during my stay. I'd also explain, if asked, our plans (like I said in the first paragraph). On top of that, I've been to the UK about 4 times to visit him before we got married in April this year and I've never had any problems. I'd bring my previous passport to prove that as I currently have a brand new one with my married name and no stamps.

Has anyone ever been through this? What do you guys think? Is it risky?

I'd appriciate if anyone could give me a light.

Thanks you in advance!

Highly unlikey since you will not be 'visiting', you'll be 'residing'

The way I see it is I'll only be using the amount of time I'm allowed to under a tourist visa to visit family (my husband), as according to the uk gov website lots of categories are included in their "tourist visa" and one of them is visiting family in the UK for up to six months.

Aye but you'll see that tourist visas for those with spouses in the UK are rarely granted and using the full six months is never a good idea even if a genuine visit, I'm afraid the ECO's fear that in these situations the temptation to attempt to stay are too much for the visitor.

You see you have to prove 'reasons to return' and having a husband in UK would knock any valid examples of those into a cocked hat.

Try it tho - it's only £80 or so though a refusal on your history is never good....

I understand it, thank you for contributing :) the thing is I don't need a previous tourist visa as I'm Brazilian. So basically I only need the stamp when I go through immigration in England. So this is why I'm worried about it.

They can still ask you questions and refuse you entry and put you on a plane back to Brazil.

In that case just 'make like a tourist'! Not too much luggage, and remember the six months in 12 'rule' - frequent visits raise eyebrows, while it's not the rulebook anymore, IO's use it as a guide.
