Post by t2ictquery » Thu Oct 22, 2015 7:45 am

Hi,
I'm on a tier 2 ict visa and wondering if I can apply for ILR after my 5 year completion.
If anyone can help by passing information will be much appreciated.

Thanks

On what date did you APPLY for original your visa and what date is it VALID from?

Tier 2 ICT does not generally lead to ILR but your answer to the above will be useful as there as specific dates that would be relevant on giving you the correct answer.

No, then you won't qualify for ILR based on Tier 2 ICT and 5 years residence.

Is May 2014 the latest extension to a pre-existing visa or is it the date of issue of the first visa?

Work Permit is the old (pre-2009) name. After 2009, it was integrated into the Points Based System (PBS) and renamed Tier 2. So, Work Permits and Tier 2 are essentially the same thing at different times.

Any Intra-Company Transfer visa for which the application was submitted after 6th April 2010 is ineligible for ILR.

As Work Permits were only issued before 2009, all Work Permit visa holders are eligible.

If you wish to settle in the UK, there are a few options open to you.

a) If your company keeps you in the UK for ten years, you would be eligible for a long residence visa. But I believe that the government has made the conditions for ICT visa holders much harder to acquire long residence as well.

b) Get your employer to change your visa to a Tier 2 General. Your employer needs to get a license for that. If you are on a Tier 2 General visa and you are paid a certain minimum salary (around £36,000 pa), then you will be eligible for ILR in 5 years time.

You said you got your visa in May 2014. You don't qualify for ILR on Tier 2 ICT if you have not had a work permit (doesn't exist anymore) previously or a Tier 2 ICT issued BEFORE 6th April 2010.

Thanks for the reply.
But it also says this,

You can have had any combination of these visas during the 5 years:

Tier 2 (Intra-Company Transfer)
Work Permit in the business and commercial category or the sports and entertainment category
Representative of an Overseas Business

Thanks

Have you had a work visa before for the UK?

If you have only had the visa you are currently on, issued in May 2014, you will not qualify for ILR on Tier 2 ICT.

Thanks for details,
I've got my first visa on May 2014. So I guess I'm not eligible.

Is it possible for my employer to switch from ICT to general? I think they have that license to do so. But not sure about switching from ICT to General.
OR
Can I change to tier1 entrepreneur and then after 5 years supply for ILR?
Please advice.

ICT to Tier 2 General possible, apply from home country, a 12 month cooling off period will apply unless you meet certain requirements (I think). Yes, your employer needs to be an approved sponsor.

Tier 1 Ent, possible, with £200,000 route only.

Is there any possibilities to switch to Tier2 General without having a 12 Month Cool Off?

Thanks

I will move your thread to the Tier 2 forum where you will get better advice from members than the ILR forum.

Besides Obie and Vinny, moonlight55 and Manci are quite knowledgeable on this issue.

Get paid more than £155,500 pa. Or switch to a dependent visa for 12 months (which means your spouse must hold a Tier 2 General).

The rules are designed to reduce net migration, so no, not really many feasible ways around it.

Not directly... you would have to wait 12 months on that visa (eg Tier 4). https://www.gov.uk/tier-4-general-visa/ ... -this-visa

Which Tier 1 visa are you thinking of? There is only Tier 1 Investor and Tier 1 Entrepreneur, both requiring substantial funds.

See similar thread below and link to guidance on £50k route if switching from Tier 2.

http://www.immigrationboards.com/uk-tie ... 96215.html

There are some changes coming into effect next month, you should read up on these and if you choose this route, make sure you qualify with all the requirements.
