Long term visitor visa for parents

Hi All,

I am on ILR and wife is on dependant of settled person visa valid until May 2017. We would like to apply for a 5 years long term visitor visa for my wife's parents who live in India. They have visited us once before on a 6 month visa.

Is it fine for us to apply for a 5 years long term visa for them? If so how can we justify the need for them to apply for a 5 year visitor visa? Both their daughters live in UK. The reason I can think of is they would like to visit and stay with their daughters and family (including a grandson) on a regular basis. They would also like to visit places and things of interest around United Kingdom. They have a house and savings in India which we can provide as proof that they will adhere to the 180 days rule during the 5 years. We have a house here in UK and can prove that we can support them financially here. Will this be sufficient? Is it ok for them to apply for a 5 year visa or is it better for them to first apply for a 2 year visa?

Not after just one visit. Need a proven track record of adhering to visit visa. Best if they have three or four under their collective belt.

Hi there,

In my case we applied for 5 year visitor visa for my mother in law successfully. She had been here only once prior to that.

Its how you present the case. If you were solely bringing your in laws to save childcare costs, then in my view it doesn't make a cut from ECO's perspective. If the in laws have independent life back home and coming here to enjoy the time by visiting you rather working for you for free! then it makes a sound case.

what evidence did you give to prove they will return. nothing special, parents bank statements, pension documents, property documents, basically showing in documents they have their independent life established back home and they have no intention to settle in the uk
how much money did you show, not particular figure but whatever they had they showed in documents, again point would be to show self sustained cash flow etc
also after how long did you apply for her long term visa since she visited once.to be honest don't remember, but it would have been within a year or two.

Can you please kindly provide a copy of your invitation letter or the template? Also how would you prove that your in law has repeated needs to visit the uk over longer period? I also want to apply for my mum on the 2/5 year visitor visa but a bit worry... Any advice will be much appreciated!!!!!

There isn't a set template. Have your parents visited the UK before and if yes, how often?

Unlikely they will be granted a longer term visit visa other than 6 months if they have only visited once.

No, not many people have and those who have been have either been lucky or there have been exceptional circumstances.
Any suggestion would be grateful because my Parents need to travel U regularly as a visitor so instead of applying Visa multiple times thinking of applying a 2 years Long term visa. Is there any other guide lines we have on this?
How regularly is their need to travel? They should not be spending substantial time in the UK as visitors with frequent visits.

Thanks for your reply. They may need to travel twice in a year and each trip would last 2-3 months. I can apply for 6 months visa but in that case they can't comeback again to UK in the same year. This is the reason I wanted to apply for 2 years. But if you suggest that it is highly unlikely for them to get 2 years Visa then not sure what I should be doing :?

You can try for a 2 year visa, if refused, you will lose the fee and the refusal will be on their record. Then they will just need to stick it out with a 6 month visa and prove they are excellent at complying.

Please remember that even with a long term visa, they can still face questions on arrival if they are making frequent long'ish visits to the UK and a long term visit visa does not guarantee them entry each time.

Firstly there is no 6 month in 12 months rule as such. What the rules do say is they are not allowed "to live in the UK or make it their residence through frequent and successive visits". That is generally understood to mean that they spend more time in their country of normal residence than in the UK.

Secondly, even if a multi-year visa is granted, each time they enter the UK the Immigration Officer at the airport can assess if they "appear to be" settling in the UK by frequent visits, thus breaking the terms of the visa and can revoke the visa at the airport and sent them back. So, a multi-year visa is not a way around the rule that they should not spend more than a reasonable amount of time in the UK.

Hello,

I am applying for a six months visa given the suggestion revived. I started filling the on-line application form but slightly confused what needs to be filled under 'Total Monthly income' section.

These are the options available in the drop down box under monthly income section.

1) Savings and Investment
2) Properties and Rents
3) Stocks and Shares
4) Public funds or benefits
5) Other sources including friends and family.

I am planning to show - 1) Pension, 2) Land , 3) House 4) Fixed deposit in the visa application for my parents. And these are my queries.

A) Which option to choose for Pension(Is it the option 5 mentioned above?)
B) How can I mention about Land or Fixed deposits under Monthly income section? or is there anywhere else in the application where I need to provide these details.

Any help would be appreciated as I am stuck and not able to complete the application form.

I think, I can choose 'Public funds or benefits' for pension amount. However, I am not sure how to mention about Fixed deposits and Land under monthly income section. For example, my Father is having a Fixed deposit of 10 Lakhs INR and a Land value of 15 Lakhs INR. But how can I present this under 'Monthy Income' part.

Can anyone please help me on this urgently. Sorry, If I am putting the question under a wrong discussion thread.

Neither Fixed Deposits nor Land are monthly incomes, are they? They are capital investments.

The interest on the Fixed Deposits (not the fixed deposits themselves) would come under "Savings and Investments".

The rent from the land would come under "Properties and Rents".

As mentioned, the income from those sources would go into the relevant sections.

Details of the actual assets could go either into the Additional Information box or a covering letter.

Thanks a lot for your reply. Sorry one more question. I am now filling the application form for my Mother. She is a house wife but the house where my parents are living is in her name. Under 'Income and Expenditure' there is a question - ''Do you have savings, properties or other income, for example from stocks and shares?'' : Should I answer this as 'no'?

If the residential house is in her name, I would interpret this as meaning that she has property.

Again, it can be explained that the property in her name is the residential family home.
