Post by neurocyber » Mon Nov 02, 2015 9:13 am

Hi all,

Any thoughts, if a country cancel valid passport of its citizen living lawfully in the U.K. as an immigrant and holds valid work visa ?

Thank you in advance.

What exactly is the question you have?

Why has your passport been cancelled?

Is this the reason you are asking about BRP cards?

Thank you to reply CR001. I was a govt servant before i arrived in the U.K.. Now i have resigned from govt. service. I suspect that govt. will cancel my passport. What will be my status in the U.K. if my passport get cancelled by govt. ? If i apply for a BRP, will that help me in future ?

Expert opinion needed. Thank you in advance.

I don't get why they would cancel your passport.

Unless you did something terrible in the employment of the government, there is no reason for your passport to be cancelled just because you resigned from your job. Is there more to this than you are willing to share?

You need a passport to be in the UK and no, a BRP won't help you either.

My employment histroy is clean and i never did any unlawful activity in U.K. aswell. I was sent to France for higher studies by my govt. and recieved a stipend as well. During studies I recieved job offer from U.K.. Without mentioning this to govt., I accepted the job offer (Tier2) and got 5 year work visa. My passport is valid till 2022 and my visa is valid till 2020.

As per govt. rules i can not apply for a job without prior permission from govt. I alspo had a contract with govt. which says "i have to go back to my home country and serve them for a specific time period or i have to pay back all expenses they did on my higher studies".

Regardless of the fact that i want to payback their spent money and I will fulfill the clauses of contract between me and govt. I can expect any thing from govt.

My question is, What will happen incase govt. will cancel my passport. Will that only restrict my travelling abroad or make me ineligible to further stay in the U.K. ? Can i continue my job on Tier2 (because i have got vaild visa.) ?

@CR001: What do you mean by "You need a passport to be in the UK" ? You mean U.K. authorities will deport me if my govt. cancel my passport ?

My plan was to stay in the U.K. on Tier2 for 5 years (validity of my visa nad passport) and at the end of visa i will apply for ILR. Can i still continue with this plan ? Thank you for in advance.

You need a passport to apply for ILR or any visa extensions and to be able to apply for British citizenship. If your passport is cancelled, then I am not sure whether your visa in your passport will be an issue or not.

However capricious the government, it is very rare for it to cancel passports of people already resident abroad, except for very serious reasons, such as what it regards as treason (e.g. Edward Snowden) or international terrorism.

The reason is simple. The passport is proof that the country stands by you and will provide support to you when you are abroad. If it were to nilly-willy cancel passports when its citizens were already abroad, other countries would be very wary of welcoming citizens of that country, as cancelling a person's passport is tantamount to saying that that country is no longer responsible for you. At the end of the day, the value of your passport arises from the fact that other countries believe that the country stands behind it. Like a cheque, it's value is based on trust.

Unnecessary cancellations would detroy that trust and that may make it difficult or impossible for holders of that passport to travel abroad. Not to mention that it is not pleasant for the country and its citizens to be ashamed of the national passport.

So, it is very rare for passports of people already abroad to be cancelled.

Issues may arise when your passport needs to be renewed or if you were to travel back to your country. They may make it difficult for you to renew your passport and of course, they can cancel your passport or put you on a no-fly list while you are in the country.

Probably best option is to pay back, according to terms of the contract, ASAP.
