Overstayer Temporary admission IS96

Would someone please help me with this. We came on visit visa 12 years ago and became overstyers due to fradulent solicitor. Me and sister were 16 year old then. Did flro in 2013 which was refused we did Judicial Review but Home office asked to withdraw and then reconsidered but refused AGAIN!! we did JR AGAIN and permission was refused so our solicitor told us to withdraw JR and do a new application because new rules are giving appeal to new applications.

We were about to do FLR FP but enforcement came home and searched the house and gave us IS96 and told us to report. but to my dad also gave RED 0001 and RED 0003 before reporting we did FLR Fp with fee waiver. and reported first time but they have called us again next week but told us nothing after that.

Now we are worried to go to reporting because we have not received any acknowledgement from Home office about this application. Soliciotr did told us they could send us the application back as invalid because we did a free application. Solicitor then told us that we could do another paid one then.

We have no ties or family or any connections to the home country because we all grew up UAE because our dad was emplyed there before coming to UK.

If we do not recieve any letter from the about the FLR FP application but when we go to reporting and they have put 'invalid' in their system, can they detain us?? How will we do a paid application from inside???
Please I am sooo worried and stressed.

free waiver will always get rejected cause there is nothing for the govt. or for the HO. They will find a flaw to refuse the application(appeal) straight away.
make a fresh application to first tier tribunal on human rights. pay a court fees.
collect data material grounds and send it to the court.
it will be better to present your case yourself rather than solicitor. judge are more likely to hear from individual and prove to them that UK is your home.

make your application quick time. if you do not make application you are more likely to be detained.
reasons- no application no grounds. detained and send back to home country.
if you are not threat to the country they might not detain you. but that's a risk.
if you get detained you are more likely to pay heavy bail and solicitor fees to come out of detention center. so its better to make application and save yourself with stress and worries.

I am not sure of the legal basis to apply to the FTT when there is no immigration decision or decision to refuse a human right claim.

This advise has no legal basis.

Thanks guys for the help :D

We have absolutely no criminal record. we went to school and college, studied here and have social life. etc.
So we are on weekly reporting while our application is pending.

I am not sure that I can do another paid application on top of while the current application with Fee waiver is still pending. Can I?

Also without an immigration decision can I do an application to the First tier tribunal?

FTT are there to decide wheter a decision made by HO right or wrong or to overturn a rueling not to take Application.
In UK HO status is setup to regularise immigrants stay here in the UK or other issues related to security or policing of the country. So any Application has to be made to the HO and after getting a decision you can then contact the Tribunals etc

In you situation your best bet is to contact your local MP if you are still waiting the acknowledgement of your fee waver application, they can then chase Home Secretary for the explanation that what is going on with your application.
