FLR

Post by Ket1 » Tue Nov 10, 2015 11:16 am

hi

My husband got his spouse visa 30 December 2014 and arrived mid Jan. since then we have been back to Pakistan once for 4 weeks.
I am aware we don't need to apply for his flr until 2017 however i am no expecting and therefore need advice before going on maternity in order to arrange how much time i need off.
our baby is due first week of may 2016. my husbands visa expires September 2017. when can i apply for his flr, will this be as soon as he has been here for 30 months so end july? or when the visa expiry date is (September)?
also is it correct we only need 6 previous payslips from the date of application so if i be on maternity and then come back to work 6 months before applying this should be ok? this is because i am aware we need to show income of 18600 or above and my partner cannot meet this alone so i need to assess the time i need to come back to work instead of taking a full year of maternity. could someone please help me it would be much appreciated!

He should apply for the extension shortly before his visa expires or as close to 30 months residence as possible, this is to avoid a shortfall later on and having to apply for an additional extension to cover the shortfall before applying for ILR.

He will also have to pay the immigration health surcharge when he applies for his extension and this cost is £500 on top of the visa fee.

Either is fine.

Should be ok. His income can also be considered if applying within the UK.
