Post by S philip » Fri Nov 13, 2015 4:42 am

Hi
My wife recently get her ILR approved , I been her Tier 2 PBS dependant from Jan 2014 so not eligible for ILR , baby also born in India Jan 2013 and applied as tier2 dependant from mar 2013 so he is also been refused for ILR sInce father is not eligible.

My concern is can she claim child benefit for our son?
Would it effect sons future ILR application ?

Childs visa will be in line with yours and will qualify for ILR when you do.

Would it effect sons future ILR application ? No, because it is not the child claiming. Only an adult can claim child benefit
If your wife is also going to claim child tax credits, this MUST be claimed in JOINT names with you. But child benefit only in her name.
