Hello All,
A quick query regarding applying for spouse visa.
My situation is I was on tier 2 perviously and granted ILR (10 years route), and my wife is still on tire 2 general dependant visa. To extend her visa do i need to apply using FLR(m)? Also I read under exceptions that: if your partner has originally had temporary work visa (tire 2 general) then you may have to apply as a ‘dependant’ (partner) in their original visa category. Is this apply to my situation. If yes which Visa we should go for?

She has no option but to apply on FLR(M). Her clock towards ILR will be reset to zero and she will have to wait 5 years (2 x 2.5 year visas) before qualfiying for ILR (unless she reaches 10 years long residence herself). You will need to meet the financial requirement, she will need to meet the English A1 level requirement and she will have to pay the immigration health surcharge of £500 before submitting her application.

This is because you applied for ILR based on long residence, she is not permitted to continue extending her current visa.
