Hi all,


My Tier 2(general)visa has been applied last Nov 3 together with my dependants,last Nov 10 is my 5th year here in the UK,after counting my absentee in the UK,my only window for applying ILR is until Dec 18 2015 only,it's 180 days exactly,or else I will fall in to ILR rule changes this coming April 2016.I read in set O guidelines that you can apply for ILR even your passport still in home office,I'm planning to apply for myself only.

My question is,what,what will happen to the application of my dependants?

You statement is confusing. you told your 5 years on Tier 2 was completed on 10th Nov and then you counted 180 days leave and again calculating your 5 years completion on 18th Dec.

Are you talking about 180 days away in a year or in 5 years ? Can you please add some more details ?

Hi,

Sorry about that,it's 180 days in a year.because I was sent by my company outside the Uk for 165 days,then I take my annual leave in the same year.

Your post is confusing. Can you list your immigration history with dates, visa issue dates and UK entry date?

Have you applied by post for Tier 2 G extension for you and your dependents and you have received a reply/visa yet?

Why did you apply for an extension when you met the 5 year residence requirement for ILR?

Can you break down your absences per 12 month cycle?

Can you list your dependents immigration history with dates?

My employer applied me for extension in tier 2 gen and I did for my dependents,all by post and I haven't recieve a reply yet,
The 165 days in 2011 from 9 May to 22 October then I take a leave from Dec 3 till Jan 6 2012 no problem the rest of the remaining years
My dependents are just 2 years here in the Uk

Absence is calculated in 12 months cycles counting backwards from the date you apply for ILR, so it is not always a calendar year. So you need to work that out per 12 month period, no one esle is going to do it for you.
