Tier 2 (ICT) to Tier 2 (General)

Hi There,

Hope someone can help with a response to my case.

I came to UK in August 2009 on ICT Tier 2 Visa. Below are the dates.
Date Visa Issued : 03/08/2009
Date I landed in UK : 15/08/2009

I was in UK till 11/09/2010 after which I was asked to setup an offshore team and work at offshore for few months. I left UK on 11/09/2010 but I worked at offshore for the same project. During my stay at offshore my ICT Tier 2 visa expired on 28/01/2011. After setting up an offshore team I was asked to travel back to UK. During my stay at offshore I didn't receive UK salary. Salary was in offshore local currency.

I was asked to travel back to UK in July 2001 so I reapplied for tier 2 visa in July 2011 and I got my visa stamped as per below dates.
ICT Tier 2 Visa Stamping : 02/08/2011
Landed in UK on 13/08/2011.

I am still working in UK.

I know I am not eligible for ILR but the query that I have is "Am I eligible to switch to tier 2(General)" ? based on teh details I have provided.

As your new entry clearance was issued after April 2010 you are subject to the 12 month cooling off period if you want to switch to Tier 2 G.

"Switching" applications are not subject to any cooling - off requirement.
