Dependent Visa

Hello everone,
I need advice from expertis,In Jan 2016 I will eligible for my ILR. But my concerns for spouse visa. whether she is eligible for ILR with me are she need to apply Flr(M) to complete two year probationary.


As she applied the visa before 9th july 2012 before Changes to the family immigration rules.The visa was valid till 6th November 2013 as of mine, then I have applied for Teir1 Eneterpernuer visa and she applied dependent at the same time,Application is till pending as of now with home office.she has completed more than 3years in this country.


I will be very greatfull if anyone enlighten there knowledge are experience in my case.

On what basis are you applying for ILR (5 years residence or 10 years long residence)?

You have a Tier 1 Ent application pending with HO for 2 years? Have you chased it up or was it refused and appealed?

First of all sorry for late reply....

I am applying on 10 years route and I have never chase up my application. Coz my sponsor for Teir1 having a dispute with Home Office, I belive case is still in the court.

Even I haven't chase my application Coz my employee after ever 6 months he does my Right To Work check. Few weeks back he did and the result was positive and in that email its clearly stated my application is still in the process.

Your wife can't apply for ILR with you if you apply based on 10 years long residence. She has no option, if she has valid leave, to apply for FLR(M) which will reset her clock for ILR to zero and she will be on a new 5 year (2 x 2.5 year visas) to ILR.

Coz my sponsor for Teir1 having a dispute with Home Office, I belive case is still in the court.

What do you mean by sponsor?? You said you applied for Tier 1 Entrepreneur visa. Who would your sponsor be?

I have applied for Teir1 Venture Capital for which I will getting the funds for doing my buisness from my sponsor.

where I belive still my application is pending, so I will be on old status which was PSW.
