Visa Appeal Procedures - Just some advice

Post by ShaliSelva » Thu Dec 10, 2015 1:05 am

Hi there,

I applied for an FLR(M) visa as an unmarried partner. My partner is British.

We were refused and encouraged to appeal the decision. We did. On the 29th of October, we sent in a file with copies of all our documents.

Last week, I received an acknowledgement of our appeal and a "copy" of all our submitted documents. However, I soon noticed that some documents were selectively left out of the copied documents that were sent to us. For example, our letter from the MP, cover letter explaining our circumstances (me being a student etc) and my new contract with RBS were left out. All these were submitted in hard copy on the 29th! I'm sure of this because I maintained several rigorous checklists during that time.

I feel like this is a terrible sign. I have already scanned the documents that were left out and emailed them to IAC's customer service.

Is there anything else I could do?

Also, does anyone know what stage the appeal is at if I've received a copy of documents that the tribunal is about to evaluate?

Many thanks,
Shali

What was the reason for the refusal of FLR(M)?

Appeal process can possible take many months.

Finances.

I only started work after graduation (August) and hadn't accrued 6 months worth of payslips. My contracted job pays £21,000 a year and that doesn't count my partner's finances as well.

Does your partner earn at or above the financial thresh hold?

For FLR(M) you can use your own income or joint incomes or your partners income on its own.

No, he doesn't make that much, unfortunately. We combined our income (based on my contracted salary) and the PSC didn't accept it. The problem is that I haven't been in FT employment for 6 months (student visa restrictions during term time).

My main concern is that the photocopies sent to us by the Tribunal seem to be missing a few pertinent documents - have you heard of this happening before?

Many thanks for your response by the way! :)
