Hello!

Please help:

My UK visa history below:

May 2012- May 2013
Tier 2 Dependant visa

May 2013 - June 2014
Tier 5 working visa

June 2014 - present
Tier 2 Dependant visa

My son, born in 2014, currently under Tier 2 Dependant visa

Query:

Am I and my son eligible to apply ILR under Tier 2 Dependant 2 year route, since my first dependant visa has been issued in 2012?

No, your clock would have reset when you applied for your Tier 2 Dependent visa in 2014 and you will need 5 years residence.

Had you remained a PBS Dependent throughout your time, you would have qualified, but changing to Tier 5 main applicant and then to Tier 2 Dependent, has worked against you.

Two more questions:

1). Can my son apply for the ILR with his father, who is qualified Tier 2 five years' route?

2). If refused the ILR of my son, will HO issue a family visa directly or they have to re-apply for family visa?

Your son's visa and requirements for ILR will likely be in line with yours.

Was your son born in the UK or was he born abroad?

My son was born abroad.
If my husband has been approved with ILR in 2017, however, my T2 dependant visa will valid till mid of 2018, shall I & my son apply for family of settlement person, or extend the T2 dependant visa for another 3 years?

Extend Tier 2 Dep for another 3 years is the quickest way to ILR.

If you apply to switch to family of settled person, your clock will be reset to zero again and you will be on a new 5 year route to ILR.
