Hello,

Much appreciate if some one can help me with this query.

I am on Tier 1 (General), and becoming eligible for ILR in July 2016. My wife is Tier 1 (dependant). We had a baby on November 2015. Query are as follows -

1. Is it necessary that I apply for Tier 1 (dependent) for my baby? I have no plans to travel abroad until I get my ILR now, so can I apply for ILR (dependent) for my baby directly at the time I convert from Tier 1 to ILR?
The reason is I will be saving the money on applying for a Tier 1 (dependent) now and then soon after (within 6 months time) apply for ILR (dependent).

2. How long can my baby live with me in UK, without a passport/visa? I mean baby is born in Nov 2015 and I will not be applying for any visa until I apply for ILR (for self) and ILR dependent for my wife and child until July 2016. Again neither me nor my family has any plans to go out of UK until we get our ILR.

Kindly help...

Do you ultimately want to apply for British Citizenship for the child?

How long has your wife been in the UK as your Tier 1 G Dependent?

ILR Dependent means you are switching visa categories for your wife to FLR(M) spouse of settled person and not applying for ILR.

Hello CR001,

Yes, I want to apply for the British citizenship for the child.
My wife have been in UK all through the time I have been, so I now realise that she will have the ILR in her own right (having been eligible for settlement for 5 years continuous legal stay in the UK).
The child can be either my or my wife's dependent I guess.

Your wife only needs 2 years residence to qualify for ILR as her dependent visa was granted initially before July 2012. She applies for ILR with you on form Set(O).

Your child DOES NOT need a visa or ILR. Once you/wife are granted ILR, you can apply to register the child as British on form MN1 under section 1(3) of the nationality act.

Do you know how long the 'Registration' process and subsequent 'getting the British passport' for my child will take?

Registration - 3-6 months.
Passport - 4 weeks.

Once Registered as British, a child passport can also be applied for using the fast track service which takes roughly one week.
