Hi,
History:
I need your advise on which category of visa I can apply to remain in the UK.
I came UK in 09/2006 for study
I was on IGES between 10/2007 - 07/08
I then switched to work permit in 07/2008 - 06/2010
Gave birth to my first child in the UK in 03/2009
I switched visa again to student between 06/2010 - 11/2013
I the switched to tier 2 in 11/2013 and is due to exp in 02/2016.
Case:
1. My first child wouldn't be 7yrs until after my visa expires by 5wks
2. I will not have stayed in the UK for 10yrs until after 7mths
3. Total time spent on work visa 57mths including IGES but less than 60moths (assuming IGES counts towards that)
4. Chance of extension of my Tier 2 is looking bleak due to down turn in oil and gas.
Request:
I would appreciate if someone could advise me on how to go about this, please.,
Regards,
Giganto

What's the status of child's father? Are you living together?

Hi Vinny
The father is a tier 2 visa holder, but his visa is due to expire in 02/2016. Actually he's an excellent immigration record in the UK, thus far.
Yes, the father leaves with the kids (2) - both of them were conceived and born in the UK and none of them has ever left UK for more than 2mothns.
Many thanks

If the father is a Tier 2 visa holder and you say "I the switched to tier 2 in 11/2013 and is due to exp in 02/2016." who is 'the other parent' who is a Tier 2 PBS Dependent?

So we appear to have three parents here.
You have a Tier 2 visa expiring 02/16
The father has a Tier 2 PBS visa expiring 02/16
The mother has a Tier 2 Dependent visa.

No, we have only two parents: The father is on a tier 2 visa and the mother is on tier 2 dependents.

In which case, when you wrote ""I the switched to tier 2 in 11/2013 and is due to exp in 02/2016" you omitted to say 'tier 2 dependent'...

My apology for the omission. I always switch my visa, where required, along with my dependents.

If your husband is the main Tier 2 G visa holder and you and the children are his dependents, then the only option you have is for your husband and the dependents to extend the existing visa.
There is no 'bridge the gap I am short' type visa.
You need to be clear on the circumstances when you post, we cannot guess and your posts are very confusing.

Once again, thanks. But is the husband qualified to extend his visa without employer's sponsorship? Or are the kids also qualified to extend their visas, if so, under which category and how?

Has your husband's sponsorship been withdrawn or has he been made redundant? Why can't he extend with his current sponsor?

My contract ends in February and with the current oil prices very much down, the prospect of getting new contract/extension is dire, the the reason for seeking advice in order to plan early.

Surely as the Tier 2 Dependant, it's your husband who needs to ensure his contract is extended...or are you taking turns to post

Not to miss the children

Looks like the family is taking turns to enjoy the experience of making posts on a online forum!
Never seen a more convoluted immigration post!
May I request the family to vote amongst themselves and choose 1 to spearhead the task of seeking answers to whom this "Giganto" id will belong. Anyone else wanting to post, now or later, create a new ID and start every post with" I am Giganto's [relationship]"!

Apologies for not adding anything useful in this thread, but I have to admit that this is one of the most hilarious posts I've seen on immi boards ...

My advice is based on personal research/experience, so pls check relevant UKVI sources.

If the main Tier 2 holder cannot extend under the sponsorship of current employers, then should find another
Tier 2 (General) sponsor ASAP.
