Tier 1G short of ILR requirements - Options?

Hi,

I have been on Tier 1 General Visa and While started to looking for ILR application now, I figured out that I am short of few days and doesn't satisfy the 90 day rule that is calculated between the Entry Visa date and the date traveling to UK with the Entry Visa. My delay was due to some medical condition but not a serious one though. Has anyone faced with this situation. Could anyone let me know if they too faced with the same situation and applied for discretionary leave with medical reasons.

Or is there an option thru an umbrella company who could sponsor tier 2 general visa. Is it legal for umbrella companies to sponsor tier 2 general visa.

It might help if you posted the visa start date, UK entry date etc or should we guess this.

No there is no such option. It is illegal to contract under an umbrella company on Tier 2 General. You need an approved sponsor.

Btw thanks for your response.

Visa start date 31-jan-2011 and I step my foot into UK on 4-06-2011 and Visa end date - 31-jan-2016.
I did an extension once in the middle on 2013.

About umbrella sponsoring tier 2, that was my opinion too. But I did get some calls that they can provide sponsor.But ignored it thinking i don't need it.But not now i guess.

It seems Tier 1 general visa candidates did another extension before the extension for the tier 1 general is closed.I was completely careless and unaware of this.My bad..

What is my option now.

1. Tier 2.
2. Tier 4.
3. Tier 1 (Investor / Entrepreneur / Exceptional Talent).
4. Marry a settled person / British citizen.
5. Marry a EU ciitzen exercising treaty rights in the UK.

Again thanks for the response.
Does Working as an IT contractor thru limited company with access to funds of 50 K and assuming i meet other requirements like Maintenenace of funds, English language make me eligible for Tier 1 enterpreneur.

Btw, is there a period specified that 50k fund should be maintained throughout some period ?

For Tier 1 Ent, if you qualify, you need to set up a business and you have to submit a business plan and a whole host of associated documents and prove you are employing people.

Is the £50k yours in your account or someone elses?

There are only certain circumstances where you can apply for Tier 1 Ent via the £50k route.

The 50 k is in business account and not on my personal account. Since I am working as a Contrator thru my own limited company. I am the Director of the limited company. I do pay corporate tax, VAT etc. Have been doing this for 2 yrs.

No, you cannot use a Tier 1 Ent visa in the same way you can use a Tier 1 G. HO are very specific about the requirements for Tier 1 Ent and applicants have to meet all the requirements.

50 K is from sales of IT services(Software developer) provided by me through my limited company. Not mine or families.I am a contractor with a limited company I have the sales invoice records to show for evidence.
My client pays to my recruitment agency who pays pays to my account.
Having said this I do understood this might not be a smooth one to get into. But need to consult a solicitor for confirmation.

You can only switch into Tier 1 Ent with the type of funds you have described under the £200K route.

To use the £50K route, you have to meet the requirement of funding in the link below

And to be honest, given your visa expires soon, you are short of time.
