Extension of few months in order to apply to ILR?

Post by eldani » Wed Jan 06, 2016 8:13 pm

Dear all,

My current contract/COS/Tier 2 General visa runs until September 2017. By September 2017 I will have lived in the UK for 4 years and 10 months with a Tier 2 General visa working with the same employer. Because of the 2 months difference I am not able to apply to ILR.

My question is, what is the minimum extension period of my contract/COS that would allow me to extend my Tier 2 General visa and apply later to ILR? For example, if my contract/COS is extended for 6 months, until Match 2018, can I extend my Tier 2 visa for 6 months and during the six months apply for ILR?

Many thanks for your advice.

Tier 2 general visa 4 years + 1 year EEA Family Permit

Post by eldani » Thu Jan 07, 2016 10:10 pm

Hi all,
In a couple of year I will have been in the UK for 4 years with a Tier 2 general visa, but my contract will not be renewed and I will not be able to renew my tier 2 general visa. However, I am eligible for the EEA family permit and can renew my residence permit. My question is, can I apply to ILR with a combination of 4 years as tier 2 general visa and 1 year eea family permit?

Many thanks for your advice.

No, you cannot.

You need 5 years in either one or the other, you cannot combine time under UK immigration rules (Tier 2 G) and EEA/EU rules to make up the 5 years.
