I am not sure you have any grounds for a human rights application.

Do you or your wife not qualify for any other visa (Tier 2 or Tier 4)?

What was the reason your Tier 1 Ent was refused?

If you mean 'buy time' till you reach 10 years long residence, it is unlikely that you will manage to stretch this for 18 months.

I don't think there is any category you can apply for as HO will argue that you could return to your home country as there are no insurmountable obstacles.

Thank you very much

So its mean I should not aply for human right?

Ok for example if me and my wife moving to our country Can we come back again if yes, then how long we should wait i mean to say is there any time restriction to come back in UK?

Or if we want to go other country like Australia Canada or us do we have any time restriction?

If you want to go to Australia or Canada, you will need to meet whatever visa requirements those countries have. I am not familiar with them.

You or your wife could apply for any visa you qualify for from home country if you leave the UK voluntarily, i.e. not deported. I am not sure if there will be an exclusion period if you leave voluntarily.

In the mean time my case in the Court of Appeal and we had also reply the S120 notice to home office. So far i am waiting the post form The Court and the Home Office.

now next wed we are going for attendance. What you think what can they do. Will they wait for court decision? and will they give us more time. Or anything

Please advise

Asking the same question again in the same post is not going to change the answer.

You don't have any apparent human rights claim. What grounds do you think you can use for human rights?

Wishing to live in the UK because it is nicer or because I have almost reach 10 years residence is not a ground for human rights.

There is no human rights angle here. Why can't you return home?

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
