Withdrawal of COS after HO approval

Hi guys

Hope you can help. I'm in a potentially precarious situation with my visa status. I applied for a Tier 2 General - switch when I was given a conditional offer by a prospective employer. The visa was just approved today with an effective start date of 7 January 2016. The issue is that the prospective employer is still conducting its onboarding (pre employment) checks and it's taking much longer than envisaged. I am obviously anxious that I may end not passing these checks and getting my offer revoked. In the event that my offer is withdrawn for whatever reason, what happens to my visa status? If I am able to Negotiate going back to my old employer,could I revert back to my leave to remain with them (despite handing in my notice) or does it mean a fresh visa application in order to work there again?

It would be a new applications if you are not able to start your new employment for whatever reason. You cannot work for employer B with a CoS and visa issued by employer A.

Your previous employer will also likely have to conduct the RLMT process again to re-employ you.

Is it possible to push back the start date when the visa is already approved?
