Hi all,

It is time for my visa renewal. I was on tier 2 general and changed to tier 2 dependent.

My partner is sponsored by rather a large firm ( over 400k employees) and they will pay all visa expenses for her and help put my application through as dependent.

The company uses an immigration lawyer so they should know all of their stuff

However for my own peice of mind, my questions are:

My partner job title changed with some more responsibilities but still doing what she initially got the visa on. This will not be an issue, will it?


Would my partner need to provide maintenance for either of us? I think answer is no as that is only needed initially.

I will be applying for ilr end of the year, would i get my nhs contribution refunded? Does one have to pay nhs cost again for ilr?

Finally, if for any reason visa isn't granted it which should not be the case, what options would we have? I have been here 9.5 years and would i loose my right for ilr for sake of few month?
I am little worried and sure everything will be fine but considering i have a kid here and built a life . It is very difficult and stressing situation if visa is not granted for any reason.

In such cases can i apply for discretionary visa?

I really appreciate you help greatly.

No, you will not get the surcharge fee back. It is your choice to apply for ILR under 10 years long residence not HO's. The health surcharge is not payable for ILR applications.

If this happens, you would need to find a visa that you qualify for or your spouse would need to appeal if appeal right is given. HO do not make exceptions because 'you are almost at 10 years'.

Many thanks and i am pretty confident all will be fine but there is always that slim chance

Would i be eligible for discrionary leave?

Would home office give you the right to apeal on t2 visa? If so if one appeals would they be able to work while waiting decision?

Not sure if you would get discretionary leave, the requirements are becoming onerous. 'Wanting' to stay in the UK is not considered a valid reason.

If you get appeal rights, your existing leave should continue and you should be covered by section 3C.

One question asked earlier is would i need to show maintenance ?

Would my partner job title change with some more responsibilities but essentially same principle as what the initial visa was granted cause any issues?

The lawyer firm will find best soc code but i am just nervous
