Child born in UK - ILR (parents do not have ILR)

Post by asif80 » Mon Jan 18, 2016 7:45 pm

Hi all

I can understand that a child born in UK can apply after parents get their ILR as he will not be illegal even if he has traveled abroad. But what if the UK born child traveled abroad without VISA but got entry clearance VISA whilst traveling back in UK. Then would that child not become illegal if his application is not made with the parents in the situation where his VISA expires.

Thanks

No, the child is still entitled to register due to being born in the UK. A valid visa for section 1(3) - entitlement registrations - is not required.
