First or Second Period of FLR(M)??

Post by MatildaX » Tue Jan 26, 2016 7:55 pm

HI,

Married a Brit, moved to the UK.

The UK stamp in my passport says "Entry Clearance." I was given 2.5 years. I'm coming up on the end of that period. I thought those first 2.5 years were the first period of leave to remain, but then shouldn't my visa say "first period of leave to remain", or something similar? Am I now to apply for first or second period of leave to remain?

Question 2.3 says tick one of the following:
"First period of leave to remain (following an initial period of entry clearance...-6 months)."
-or-
"Second period of leave to remain (following initial grant of leave to remain)."

I wonder if I missed something and was supposed to apply for first period of leave to remain after the "Entry Clearance." My visa says valid until 26/03/2016, so, like I said, 2.5 years.

Thanks for your help!

The first period (6 months) refers to someone who entered on a fiance visa.

You are applying for your second period of leave - form FLR(M)

Are you sure Char? The OP says "I was given 2.5 years. I'm coming up on the end of that period." :?

The full sentence is in the form is below. If the first extension of spouse visa after the initial 'entry clearance visa', this would appear to be the correct choice. The second choice would be if someone switched to FLR(M) in the UK (from Tier 2 G for example).
First period of leave to remain (following an initial period of entry clearance as a partner of a
settled person, or following an initial period of entry clearance as a fiancé(e) or proposed civil
partner of a settled person - 6 months)
