Confusion About Financial Requirement For Spouse Visa

Hi everyone,

I got ILR through 10 year long residence route. I have wife and two kids outside UK and want to apply dependent visa for them. I started PAYE job in April 2015 and so far earning more than what is required as per financial requirement of one partner and two kids which is £24,800. My salary is different each month because dont have fixed hours each month but already got this total amount of £24,800 in month 10 of this current tax year which will end in april 2016. My question are

1) Are Holiday payments in payslips count towards financial requirements ?

2) If i apply in may 2016(first month of next tax year) and stay with same employer would i need payslips of all previous 13 months (12 month of previous tax year of 2015-2016 + 1 month of present tax year of 2016-2017)or would only need payslips of last 6 months irrespective of tax years? same question for bank statement that whether i would need bank statements for last 6 months if working with same employer more than one year

If your contracted salary is below the financial requirement for your family, then I think you need payslips for the past 12 months. Don't think you'll need bank statement for the whole period. I believe all these requirements are there in the Guide.

thanks for reply. I actually read the guide and was confuse thats why asked in here but it seem its quiet hard for others to answer it

I am working on hourly rate and my monthly salary depend on numbers of hours i work in each months and so far i worked in 10 month since april and reached the amount required ..my confusion is once tax year end in narch 2016 then if i am in same job and apply during first month of next tax year start in april 2016 then would need last 6month payslips or last 12 months

You need to apply category B, non salaried. Provide 12 months of bank statements and payslips. Doesn't matter how long it took to make up the money, as long as you made it in last 12 months. so you could have made all the money in one month, but provide all previous 12 months slips and statements.

why some need to show last 6 months payslips and bank statements while some others need to provide last 12 months?

and also when i will apply for my wife and kids who are outside UK then what categories it will be? settlement ? family visa?

6 months is for people who are Cat B and monthly paid with a fixed monthly income, i.e. NOT hourly paid, which varies.

so if someone is on zero hour contracts and not getting fixed contract salary per annum then they will need last 12 months payslips and bank statement irrespective of any tax period because we all know in april new tax year start

from guide ..cannot i apply under category A of non salaried employement?

Where the person is in salaried employment – they must have been paid throughout
the period of 6 months prior to the date of application at a level of gross annual salary
which equals or exceeds the level relied upon in the application. Therefore the figure
used towards the requirement will be the lowest level of annual salary received during
the 6 month period.

Where the person is in non-salaried employment – the level of gross annual
employment income relied upon in the application will be the annual equivalent of the
person’s average gross monthly income from non-salaried employment in the 6 months
prior to the date of application (where that employment was held throughout that period).
To calculate this annualised average for non-salaried employment in Category A the
following calculation should be used:

(Total gross income from employment held throughout the 6 month period, divided by
6) multiplied by 12 = Income from non-salaried employment that can be counted towards
the financial requirement.

Cat A = 6 months of salary/overtime/bonus, divided by 6, * 12 = calculation to make up £18,600
Cat B = 12 months of salary/overtime/bonus added up to make up £18,600

so i can apply under Category A of non salaried employment asked for last 6 months if i am getting salary at hourly rate and i make up the required amount even though my salary of each month is not same..

my confusion is where do i fit in as there are non salaried option in boht category A and B
