I would like a clearer answer than this though... is this technically illegal? is the company risking me being banned from countries?? i would like a definite yes or no..

Very illegal and not only liable for a Schengen-wide ban, but also have a new arsehole ripped by the German Finazamt, they will look for you, they will find you, and they will kill you.
