My TIRE 2 Employer License Revoked

Hello Everyone,

I am currently working for a Company where i got Tier2 visa and their license has been revoked due to some issue and we(Employees) haven't got any letters from UKBA and Our Company is running as normal and we are getting paid like before without any issues. I have checked TIRE 2 list of sponsors in UKBA and our company name is not there anymore. I didnot get any letter home office It's already 2 months completed.
My Questions are:

1. Because our company is not in sponsors list anymore is that mean existing employees are fine but company cant take any new employees?
2. I am planning to Visit India in Feb 2nd week for 4 weeks and can I travel on existing company visa and able to come back and also i want to apply dependent visa for my wife.
3. If I switch to any other company do they need to go through RLMT(Resident Labour Market Test) to sponsor and employee me(I have converted from PSW to TIRE 2).

Please let me know ASAP

1. You cannot work for your company if they no longer have a sponsorship license. Likely you will still get a visa curtailment letter if HO have your correct and current address to send you one.

2. Risky, if your visa has already been curtailed, you might have a lot of difficulty re-entering the UK. A member recently was denied re-entry for travelling in her curtailment period and told to apply for a new visa from her home country. Re your dependents, you should apply for them once you have a new sponsor and job.

3. Yes, they will have to do RLMT. Doesn't matter that you WERE on PSW, you are no longer applying for Tier 2 from PSW. The Tier 2 G to Tier 2 G switch rules will apply to you.

I would not travel to India as proposed as the chances of being refused reentry are very high.
Technically if you have not been curtailed you still have a valid visa and you should be able to travel BUT the question is did / does the HO have your current home address. If not you may have been curtailed without being aware. If that is the case the general view at port is that if you have not submitted a new application in country already and there is only a few days left on your visa expect to be refused entry.
The other point to note is if your Sponsor lost their licence because of non genuine vacancy issues you can expect that any future applications you make are more than likely to be scrutinised to a great degree. Very few non genuine vacancy cases get through a second application for the obvious reason there has been collusion in jerrymandering a role to attempt to by pass the rules.
They can't be bothered to curtail on the collusion reason as it gives a right of appeal so they just curtail under revoked licence and wait to see where you pop up next.... Also lets them get there hands on another Sponsor likely to be failing in their duties, RLMT, non genuine vacancy etc.

Hi guys,

I wonder if anyone can reply to my query.

I'm currently on T2 G and my sponsor was suspended last week. My tier 2's extension is due in April 2016. Let's say if the UKV&I doesn't reinstate our licence by April 2016, what options do I have under suspension ? Will I be in the position to extend my tier 2 visa if the company is suspended but not revoked.

You can not extended your visa if your Sponsor is suspended as the Sponsor can not issue a COS while suspended.
