Apply spouse visa on Limited Leave to Remain

Hi Everyone

I hope some one can guide me here as I am extremely confused. I have looked at the rules and just cannot find the correct one that applies to me.

I applied for ILR but instead was granted with LLR (30 months) based on private life.
I got married in Pakistan in December 2015 and now want to apply for her visa clearance.

The rules in which I can apply for her visa states: I have to be either

a British Citizen or
Present and settled in uk or
in the UK with limited leave as a refugee or person granted humanitarian protection

i do not come in any of these.

Can some one please guide me . I will be extremely thankful

In which case you will be unable to sponsor your wife until you are granted ILR (settled status). Why were you refused ILR?

I was refused because the duration of 10 years was broken according to the home office.

So what is your full immigration history then if HO claimed your continuous residence was broken? Your previous posts don't show any information on your ILR application of your full immigration history.

Hi

I Came to UK in Dec 2004
Applied PSW April 2012
Went on Appeal.
First Tribunal refused February 2013.
Upper Tribunal Refused March 2013.
Final Decision Came from Court of Appeal in May 2014
Applied for Student Visa June 2014
Varied my application for ILR October 2014
Got LLR Feb 2015 for 30 months, (ILR Refused but granted LLR)

According to the Home Office my period was broken from March 2013, but my final decision was given in May 2014.

I have appealed against their decision for which I am awaiting reply.

You can't sponsor your wife with the LLR visa you have.

This 30 months that you were given seems very dodgy and you must challenge it. In any event, you have not lived in the UK for 20 years to be able to qualify for it.

I am thinking that your section 3C continued when you were at the court of appeal, unless your lawyer was seeking to appeal an excluded decision, of a refusal of permission to the Court of Appeal.

Obie what's the significance for 28 years of residence for LLR? Am I missing something?
