Housing Benefit Wife Subject to Immigration Control

Hi,

I am a British Citizen and working full Time. I have 2 kids and partner who is on spouse visa that is due to be extended next year. I applied for council housing and they advised me to apply for Housing benefit which could help me in rent. I spoke to claim officer and she advised me that If I claim council house or housing benefit then it will affect my wife immigration status. Can someone please give me advise on this issue. I dont want to risk my wife's immigration status.

Correct. You can only be awarded housing benefit or Council housing as a single person with two children. Your wife can't be included in the application until she is no longer under Immigration control. You should claim Child Benefit in your name and child tax credits/working tax credits in joint names.
(Casa, not CR001)

Thanks very much for your reply. My concern is her immigration status. Will she face any problem for her visa extension or ILR if I continue my application for housing or housing benefit. I will highly appreciate your advice on that.

If you qualify for housing benefit, you can only claim the single person plus 2 kids rate. It should not affect spouse visa.

Bear in mind that you/spouse will need to meet the financial requirement again when FLR(M) extension or ILR is applied for.
