Best Options for Application - Please Advise

Post by Lady D » Sat Feb 20, 2016 9:52 pm

Hello Everyone,

I hope you are all well. My visa is running out in early June and I need some advice before making a fresh application to UKVI.

I am considering going for settlement through 10 years long residency rules.
Do I qualify for this based on my current status;

I was granted 2 and half years ( expiring in June 2016 ) under appendix fm as a single parent of a British child.

I entered the UK on a student dependant visa in January 2003 and renewed my visa together with my ex partner until August 2007 when the HO refused to extend our visas. We made appeals and several representations and reconsiderations letters were sent but to no avail. The HO just kept our passports. My marriage broke down with student partner and I met another man (British) and had a child with him. I also have two older children who are 10 and 7 years old with ex partner.

From the above it is clear that I have been in the UK continously for 13 years, although legal residence has been 7 years by the time my current visa expires. I have never been out of the UK since I entered.

The UKVI website states that if I don't meet the long residency rules I may be granted another 2.5 years.

So do you think it is worth going for settlement under long residence?

I will be grateful to hear from you with some guidance on the above.

Many thanks

I have moved your post to its own topic to avoid confusion where you had posted in another members topic. It is also considered rude to hijack someone else thread especially when you circumstances bear no relevance to where you posted.

It is unlikely you will qualify on the basis of 10 years if you had a gap in 2007 after exhausting all appeals etc.

When were you granted you current visa?

I do apologise for posting in someone's space. It was not intentional. I did know how to post a new message on the forum.
By the way thanks for the advice. My current visa was granted on 5th December 2013.

Please what do you suggest I do? Can I go on the 5 year parent route?

Many thanks

What exactly does your visa say?

Likely you will need an extension for another 2.5 years.

Then you will need another 3 extensions. I am not sure if you can switch from the 10 year route to the 5 year route.

Besides the visa application fee, you will also have to pay the immigration health surcharge which is £500 for a 2.5 year extension.
