what do i apply for 5years or 10 years

i came in on a student visa, which expired on 2011, i sat for my exams shortly before my visa expired, but sadly my results were not due to December, and visa was to expire in October, my school said they could not give me a CAS letter because of the new changes in immigration rule, which says i needed to show progression, that was not possible since my results where not out yet, i was told to get intouch with home office, so that they can issue me a CAS, letter, my lawyer sent a letter to the home office to which they acknowledge, but did not give a reply, in 2013, i got another letter from the home office to apology's for the delay in giving me a response, several letters later and till date they are yet to reply
My marriage has collapsed as a result and i am left with the care of my daughter, my ex is also subject to immigration control and also an over stayer, to cut the long story short, my daughter is now British (she was taken into care, my mum (British and me were awarded custody) she got her ILR from my mum and then applied for citizenship and was given, now this is my question
Can i make an application under the 5 year route or do i make my application under the 10 route as the parent of a British citizen

Yes it is, my daughter has been granted her citizenship and i am hoping that i can make an application based on that, so i want to know if i can an application for 5yrs or 10yrs
