What should I do if my visa expired before wedding ceremony?

Post by Sashimi » Thu Feb 25, 2016 3:34 pm

Hi,

I enter UK at 3 OCT with visa-free access. Me and my bf have given the notice of marriage but we cannot settle the date for the wedding ceremony before the 6 month of my stay, the latest one we can get is 19 April. Can I stay and finish the ceremony or should I update my visa?

What is your nationality?

Not sure if you can marry as a 'visitor' - let's see what other senior members think about that.

Whatever you do you don't want to overstay any permission to be in UK - that will ruin more than honeymoon.

And you do realise of course that you have to leave the UK and apply for a spouse visa from your home country (assuming you bf is British or holds ILR)

And being here for 6 months is seen as 'residing' not 'visiting'

Also, have you been notified by the Home Office whether you will both be required to attend an interview before the wedding can take place? Your visa will not be extended to enable you to marry. See the below UKVI information on what you can't do on a visitor visa:
You can’t:
do paid or unpaid work
live in the UK for long periods of time through frequent visits
get public funds
marry or register a civil partnership, or give notice of marriage or civil partnership
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
