Switching from Tier 2 General to Tier 2 Dependant

Post by Coto83 » Mon Feb 29, 2016 1:06 pm

Hello,
My wife and myself are both working in the UK and holding a Tier 2 General Visa (each of us, sponsored by our employers). It happens that she might find a new job, in which this new employer will not be offering visa sponsorship for her, so the question is:

1. Can she switch from Tier 2 General Visa (sponsored) to a Tier 2 General Visa (Dependant) with my visa?

2. Can she do it within the UK? or she needs to resign from her current T2 General Visa, go back to our home country, and then apply from there to the Tier 2 dependant visa?

Thanks a lot,

Regards,

Coto

1. Yes

2. Yes, she can switch within the UK. She can switch at any time, even while still employed with her sponsor. She will of course have to update her sponsor/employer of her new visa status.

Be aware that she will be on a new 5 year route to ILR. She cannot combine the time she has already spent on Tier 2 G with the new 5 year as Tier 2 Dep
Char (CR001 not Casa)
