Tier 2 Sponsorship for already existing employee

Post by rajrea » Wed Mar 02, 2016 8:25 pm

Hai All,

I'm posting this on behalf of my friend.

She is on Tier 1 dependent visa and working in a company (from past 1 year ) who got Tier 2 licence.
Now she wants to change from Tier 1 dependent to Tier 2 General Main Applicant - As per UKBA rules she needs to apply from her Home country if she wants to shift from Tier 1 dependent to Tier 2 General

Does anyone know the Timelines for Out of country (Hyderabad, India ) applications on Tier 2 ?

My Query is :
As she has been employed with the same company for a year in UK, once they receive the rights to sponsor and apply for COS - How company can prove that they have done Genuine Resident labour Market test ?

The Reason why I've this question is - I've seen some one posting in this forum that their application has been rejected due to Company has not done Genuine Resident labour Market test as company wants to hire existing employee
Could experts please share your thoughts on this. Thanks

If the company is an approved sponsor, they should know what is required for a full and proper RLMT process and the proof that no Settled/BC or EU citizen is suitable for the job and that your 'friend' has not been pre-selected for the job and RLMT is just a fluffy ruse.

Why does your 'friend' want to change visas and start the clock towards ILR again?

How long has your 'friend' been in the UK as a Tier 1 Dep?

Because the poster is asking about switching from dependent to main applicant and 5 years residence will be required as Tier 2 G main applicant to qualify for ILR. Time as a dependent cannot be used to make up the 5 years. It can ONLY be used for 10 years long residence.

Please continue further questions about your application in your own thread to avoid confusion.
