Tier 2 dependent to Tier 2 ICT

Hi,

I am currently on Tier 2 ICT Dependent VISA and have been working for an UK MNC for last 1 year. I have been recruited in UK and is an UK employee. Now because my husband's visa is expiring, can my employer sponsor Tier 2 ICT Visa for me since I have been working more than one year with them ?

Please help.

You can apply for Tier 2 General if you and your sponsor meet all the requirements. You will have to apply from your home country.

Tier 2 ICT and working for your employer for 12 months refers to you working for them in your home country for 12 months not in the UK.

Thanks for your reply. For applying for Tier 2 General, does the job needs to be re-advertised for RLMT ?

Yes, RLMT will have to be completed in the full and proper process. If UKVI thinks she was pre-selected for the position and RLMT was just a fluffy process, she will likely face a refusal.

Can you please let me know if it is mandatory for RLMT that a job be posted on Jobcentre plus?

yes, it's mandatory to advertise on JobCentre.

Please refer to section 28 of the Tier 2 guideline.

It does say in Many Cases - Can you pls clarify?

This is mandatory for certain jobs. Does it specify anywhere for which job , jobcentre advert is required?
