Financial Requirements for Spouse Entry Visa

Post by Alos » Sat Mar 26, 2016 6:09 am

Hello Members. Can any one please advice. Spouse Entry clearance visa applicant's sponsor is paid an annual gross of 30,000 Pounds. He has been working for the same employer more than 3 years now and has his salary increased to 36,000 Pounds effective from April 2016 with the same employer.
He is planning to apply for his wife to join him in the UK on spouse visa in two months time. In the six months preceding the application date, he will have 4 pay slips with 2500 Pound monthly payment and 2 pay slips of 3000 Pounds monthly payment (as per the new raise in salary).

Can he simply apply as Cat A (Six months with the same employer) although his gross salary has now changed and write the gross salary as the new gross while supplying 4 pay slips which does not match the new gross or write the gross as the old gross and again supplying 2 pay slips which are different from the others (despite both sets exceeding the required amount)

He is trying to avoid giving the ECO an avoidable procedural reason for refusal and would appreciate your kind advice.

Yes, 6 months payslips like this should be fine. If you have a letter informing you of increase, you can submit that too.

As both of your salaries meet the financial requirement, you are ok, unless there is something specific you think will be an issue.

Thank you CR001.
No specific issue really. Just was a bit confused about the wording of Appendix F2 (the Financial Requirement Form to be submitted with the visa application.

"3.11 What is your sponsor’s annual income from this employment before tax? >>>>>>>>>>>>>> £
3.12 Has your sponsor been in employment with the same employer and earning the amount, as detailed in 3.11 above,

Actually the full wording in the form is:

Has your sponsor been in employment with the same employer and earning the amount, as detailed in 3.11 above, continuously for 6 months prior to the date of the application? (Category A)

Members any advice please as to the answer of the above 2 questions in the Financial requirement appendix 2?
3.11 What is your sponsor’s annual income from this employment before tax? >>>>>>>>>>>>>> £
and
3.12: Has your sponsor been in employment with the same employer and earning the amount, as detailed in 3.11 above, continuously for 6 months prior to the date of the application? (Category A).

The sponsor has not been earning that amount continuously for 6 months although he was earning an amount above the required 18,600.
If his reply to 3.12 is no then the form directs him to questions about 2nd employment which he does not have.
