Hi,

I am a British Citizen and sponsored my father to visit me .

In the sponsorship form I stated that my brothers are responsible for maintaining my father as he is retired. Along with provided my father's rental income of two properties which agrees with the bank statement. I also provided remittance information which I send to my father as a Gift.

However, In the refusal letter they have stated that they are completely satisfied that I can maintain and accommodate my father but they think that he will not return back to Pakistan.

The reason for refusal was "we didn't provide my brothers' income detail " I think it is very stupid reason to refuse because what my brothers' income got to do with him coming to the UK .

I am just wondering if there is anything we can do i.e. Administrative review to overturn the decision.

Address the issues and reapply. AR won't help as you didn't provide documents based on what you have stated.

If you stated your brothers maintain him, then you should have submitted evidence of this and your brothers financial circumstances.

Why my brothers' income details are important when I am sponsoring and they are satisfied with it..

Because you made this statement below in the application. Anything you state or claim are the circumstances in the home country, should be backed up with evidence.

I completely understand what you are saying.

However, If I am wholly and exclusively sponsoring and as they stated they are satisfied too then why it is important ....

My brothers' maintain my dad -
- he got his own property which provided .
- evidence that I send him money

If I had sponsored my brother then, it would have been a valid reason.

Do you think this refusal will matter if we make a fresh application in 6 months time.

It is your fathers responsibility to prove with evidence what his circumstances are in his home country. If you stated on the form that your brothers maintain him (and provide financial assistance), the ECO would have expected to see evidence of this.

Had you not put this in the form, it likely would not have been an issue or even raised. He can reapply at any point provided he addresses the issue.

An example if you like would be, say your sister is a housewife and wants to visit you and you say you are sponsoring her but you complete on the form that her husband (your brother in law) maintains her, ECO will expect to see proof of income/finances etc supporting the person applying for the visit visa.

if they would have asked us this information then it could have resolved there and then.

Do you think it is worth involving the solicitor ?
Is there any time limit to re-apply or I can re-apply straight away.

I think once we rectified this issue there is no guarantee they would not find a new excuse.

That is why your father should submit more than might be necessary to demonstrate his true and accurate circumstances in his home country.

Take note that if you apply and leave out the bit about your brothers 'maintaining' him, UKVI will have an issue as they keep records of all refusals etc.
