Mother's Visitor Visa rejected 3rd time

Mother's Visitor Visa rejected 3rd time

Hi,

I am devastated with outcome of my mother's visitor visa application to UK, they rejected with a silly reason that she is completely dependent on me financially. She is un-educated, un-employed widower staying alone in India. She is not getting any pension.

I have shown below evidences..

1. Fixed deposit on her name, but with the money I have given
2. Monthly money transfer from UK to her account for her maintenance.
3. My sister's address proff, to tell that she is living very close to where my lives
4. My mother's siblings passport copies to prove that they are also living close to my mother
5. Property docuemnts on her name

apart from these I am not sure what documents proves that she has good family tie ups and financial tie ups back in India.

So widows who are not employed, and staying alone in India don't have a right to visit their children settled aboread ? is in't it againest human rights ?

No. You can visit her of course.

Fixed deposits are not considered for available funds. Any funds must be in an accessible and immediately available bank account.

What was the exact wording of the refusal?

Hi CR001,

I attached the rejection wording, I some how didn't accept the rules she mentioned with the evidences I provided.

The CW told that he/she followed paragraph V4.2 of Appendix V: Immigration Rule for Visistors and Paragraph V4.2 (a), (c) and (e)

V 4.2 The applicant must satisfy the decision maker that they are a genuine visitor. This means that the applicant:
(a) will leave the UK at the end of their visit; and
She provided all her existing propeties house, land, my sister staying close by

(c) is genuinely seeking entry for a purpose that is permitted by the visitor routes (these are listed in Appendices 3, 4 and 5); and
She meets Appendix 3 as the intention is to visit family

(e) must have sufficient funds to cover all reasonable costs in relation to their visit without working or accessing public funds. This includes the cost of the return or onward journey, any costs relating to dependants, and the cost of planned activities such as private medical treatment.
I have sent a sponsor letter confirming that I will bare all the expenses including travel, food and accomodation with all the evidences my bank statements, ILR, accomodation proofs.

Appendix 3
Tourism and leisure
3 A visitor may visit friends and family and / or come to the UK for a holiday.

Appendix 4 and 5 are not relevant for family visit visa.

2nd Para in the decision section her letter:
How can a single widower in India who is not employed can survive without getting money from his/her son and what is wrong with that, if they don't like they should reject visas to all widwors who are staying single and not getting monthly income from job or rentals.

3rd Para in the decision section in her letter:
We already provided her ties with my own sister who is staying very close by and we also provided my mother siblings passport copies to prove that they too stay close by. and w.r.t social ties what can she is there in the same house from 26 years and she is a homemaker she cannot socialize.

Are you the only child?

Given that you support her fully financially and have stated that she is visiting for 6 months, she doesn't appear to be a genuine visitor.

What other reasons does she have to leave the UK if you are here (possibly the only child)?

I am not the only child, I have a sister who is married and staying with her family. My mother have close bonding with my sister and also her own siblings. The only thing which I didn't mentioned till now is my grandmother (father's mother) she is staying alone too.

What do you think about meeting that rules, does any of my comments be considered if i reapply or raise a complaint

Did you managed to reapply or made a complaint? Any more news in your case? I am in similar situation. Lack of family ties as all my siblings are married and living in or gee countries. My mother attached my father's details as a family tie but still refused. What other family tie can be shown or more important than a husband of 36 years.
I also supplied an affidavit to proof the source of funds but the aeCO wants source of funds. Source of funds was an affidavit to show the funds were gifted to my mother by my younger married Sister. What else can I show to prove my mother will not stay in uk forever . She has been to UK twice previously
