Maternity Pay Eligibility For Tier 2 Migrant

Hi

I seek information regarding the Maternity Allowance. I am on sponsored visa by my employer (Tier 2 Gen). I am expecting my delivery in Sept 2016 & would like to be in India for this. I am not eligible for Employer Maternity Pay or SMP since I joined my employer late. But I do qualify for Maternity Allowance.

I have below queries:

1. Am I eligible for applying Maternity Allowance if I choose to give birth to baby in India?

2. I would be spending part of my Maternity Leaves in India, would that impact the payment of this allowance?

3. Do I qualify for Child Care Benefit?

Any help on the above would be greatly appreciated.

1. You cannot claim a UK allowance if you are not in the UK.

2. Yes it will, you have to notify them if you are leaving or not in the UK and it will be stopped.

3. No, you cannot claim child benefit if that is what you mean by 'child care benefit'.
