Hello Members,

Can you please confirm if I am filing the correct application this time.
Previously, due to lack of knowledge I have applied for SETTLEMENT and got Refused.

FATHER - ILR (Previously Tier 1 General)
MOTHER - PBS DEPENDANT (Tier 1 General, she is not eligible for ILR as she came recently to UK in 2013)
CHILD - BORN IN INDIA

1. I am filling the online application form and selected following:

REASON FOR VISIT - Work
VISA TYPE: Tier 1 (General) - dependants only
SUB TYPE: Tier 1 (General) Child

Is this correct?

2. Have you made an application to the Home Office to remain in the UK in the last 10 years?
Should I say Yes/NO?

I had made following application 'CHILD OR OTHER DEPENDANT OF SETTLEMENT PERSON' which has been Refused.

3. Have been refused entry to the UK in the last 10 years?
Should I say Yes/NO?

4. Under MAIN APPLICANT section:

I think Main Applicant is me and I have filled all my details. Is this correct or do I need to fill mother details as VISA will be issued inline with mother visa.

1. Yes

2. You need to say yes because if you say no, you are not being truthful.

3. No, child has not traveled so obviously not been refused entry.

4. Main applicant is the child. Only the child is applying.

Many thanks for qucik response.

Sorry, I am a bit more confused now with my question 4, which is related to section MAIN APPLICANT. There are several questions, which I am unable to answer if Child is the Main Applicant.

Looks like all these are question to the current applicant(Child) regarding thier Sponsor/Father(ILR)/Mother(PBS Dependant). Please correct me if I am worng.

If Child is the main applicant, what answers do I need to give for the following?
- Are you accompanying the main applicant or joining them later?
- How are you related to the main applicant?
- Does the main applicant have a Certificate of Sponsorship or Confirmation of Acceptance for Studies number?
- Is the main applicant living in the UK?
- What permission do they have to stay in the UK?
- What job/course of study is the main applicant doing in the UK?
- What is the address where the main applicant works or studies?
- What is the start date of the job or course?

I am sorry, you haven't got my question.

You said in earlier thread that
4. Main applicant is the child. Only the child is applying.

My question is, if Child is Main Applicant, all the below questions are still related to Child and not the Sponsor/Parent?

Also, for following question, can we say 'Yes', as the Main applicant(Child) is still in India

- Is the main applicant living in the UK? Yes

I assume all these details are related to the Parent/Sponsor who is already in UK and sponsoring for their dependant's.
- Please correct me if I am wrong.

Hi CR001,

Many thanks on this. Really this form is so confusing. There is NO separate section for Sponsor details and therefore I am assuming Main Applicant is Parent.

To clarify a bit more on this:
The application contains following sections:
Passport and Travel Information -
Personal details and Travel History -
Family Details -
Medical Treatment -
Maintenance - This has follwoing options (Not sure I have to select option a or b now :( ...)
a. Own/Main Applicant,
b. Parent/legal guardian,
c. Tier 2 skilled worked with A rated sponsor
d. Tier 4 General Studen who has official financial stamp
Main Applicant - This has all the below questions I mentioned.

The "main applicant" being referred to here is the PBS migrant (or ILR/BC parent who was the erstwhile main PBS migrant before ILR/BC) who the "applicant" will be depending on for the purpose of this "dependant" application.
The child is the "applicant".

Hi Geriatrix,

Thanks for your quick response.

It's clear now. I was the PBS Migrant before my ILR and my wife is still on PBS Dependant migrant and therefore the Main Applicant section refers to my details. The application will be same as how I applied to my wife earlier, instead spouse I have to make application under child and funds I should now show for two dependants.

Please correct me if I am wrong.

Also, I just have 2 more questions, Can you please clear on these as well if you don't mind.

1. As the VISA will be issued inline to Mother VISA and in the application form there NO section to fill the Mother VISA details. Will the case worker check the VISA expiry date on the documents submitted(Passport and BRP) by my wife?

2. Do I need to fill any Appendix form?

1. The caseworker doesn't need to see your wife's BRP to figure the expiry date of her leave. The caseworker will be able to see it in their records.
2. The online application process will tell you if you need to fill any appendix.

You can't see them in the other thread because that post has been removed. You don't need to post the same thing in 10 topics .. you can continue in your own, existing topic.

Hi Geriatrix,

couple of more doubts, can you please clarify on these as well?

1. For following question, Have you been refused a visa for any country including the UK in the last 10 years?
I selected YES and under Reason for refusal, can I give the refused application reference number as I am unable to fill the reasons specified due to the text field accepting only few characters? OR Shall I say that 'applied for settlement instead pbs dependant' and specify all the reasons for refusal under 'Additional information' section?

2. Previously though I submitted original bank statements, case worker said that they are not originals. What else I can do in this case. Shall I write that these are originals under 'Additional information' section of the application.

No, not if you are applying for a PBS Dependent visa.

If you read the link you have provided properly, you will see it is for the form VAF4A - spouse/child settlement visa.
