Child and housing benefit

Hi All,

Forum is really useful and full of information. Thanks for those who created this.

I have few questions regarding benefit and need expert advise

I'm on ILR and my 3 kids are British but my wife is my dependent.
I have read few previous posts and concluded that I can apply

- Child benefit just only on my name. Is this correct?
- Child Tax Credit should claim jointly including wife but wondering why I have to include her name and if I have to, will this effect her Visa and ILR which is due in 2020?
- Can I apply housing benefit as well and how will this effect my wife extension and ILR?

Please advise. Thanks

1. Yes

2. Yes, you have to include her since her earnings (if any) would lower any claim. If you claimed as youself only you wold get more CTC which obviously isn't fair.

3. Yes, same as above, joint claim.

Housing benefit can only be claimed as a single person + 3 children. Your wife cannot be included in the calculation for eligibility of Housing benefit as she is not entitled to this and it can affect her future HO applications.

A point to add though, if your wife works, her income will be taken into account with your income, for YOUR + kids HB entitlement.

Amber she is Afghani.
Cr001/Amber, I am working part time now £12000.00 per year and do understand will have to fulfil threshold £18600.00 prior to wife extension.
Can I claim child tax credit or housing benefit while I am earing £12000.00 p. year, will it affect my wife future application as threshold is £18600.00 to extend visa? I will update the council and HMRC if my circumstances change. Please advise. Thanks

You can claim tax credit (joint) but you can't use benefit income to reach the threshold I'm afraid.

Sorry I think I did not explain well.

I do understand I can not add benefit to meet threshold to extend wife extension but I meant if I claim now housing and CT as I'm working part time on £12000.00 p. year, will these housing benefit/CT affect my wife future application because of earning is less than £18600.00 even extension is due @ end of 2018?

I will find full time or another job to meet threshold 6/12 months before I apply. Please advise, other members can also comment. Thanks

You need to meet the financial requirement at the time of extension with the most recent 6 months payslips and bank statements.
