Settlement Visa for Spouse and children - Documentation

Dear experts,

I got my ILR last year on 5 Jan 2015. My family( spouse and 2 children aged 7 and 11 years) is in India and in process of applying UK settlement visa online( https://www.visa4uk.fco.gov.uk).My family has lived in UK earlier -
- Apr 2010 - Apr 2012 (Visa - Tier 2 dependent)
- May 2014 - June 2014 (Visa - Tier 2 dependent)

Can you please share list of documentation required.

There is specific query on meeting English language requirements - My wife holds Bachelors Degree from Mumbai University. Would this suffice ? OR she has to take an English Proficiency test as per UKBA guidelines. Please advise.

She will need a NARIC English Language Assessment if she wants to use her degree.

Do you meet the financial requirement of £24,800pa?

Thank you for swift response.

Yes I meet criteria for £24,800 p.a. As self employed what documentation I need to establish this. Would Business account alone would suffice.

There is also question around accommodation.I am currently renting as in house sharing arrangement and do not have utility bills on my name. I am planning to rent a place on my name before family arrives. Could this be issue for settlement visa processing of my family.

Also, I would appreciate if you can point to more recent post/list of documentation requirements for settlement visa.

If you are only renting a room in a house share, this will not be acceptable to the UKVI for yourself, wife and 2 children. You will need to secure appropriate accommodation before they apply.

You need 6 months bank statements and 6 months salary slips if you are employed. You need more and other documents if you are self employed.
Adequate accomodation
English for wife
Employment contract and letter from employer
Marriage certificate
Children's birth certificates

Any documents not in English will need to be officially translated.

Also bear in mind that for self-employed earnings it is the nett amount after allowable business expenses have been deducted which the qualifying figure. i.e the figure on which HMRC have calculated for tax due. Not gross income.

NHS surcharge - Does it apply in my situation where Family is applying for Settlement outside UK ? I refer following link. My understanding is it does not apply in my case. Please correct.

Earlier post in thread suggested to take NARIC English Language Assessment for wife applying for settlement. Can this assessment be done in India.

Yes it does apply to your family. The website link you have provided does not say that Indian citizens are exempt.

Each dependent has to pay £600 immigration health surcharge before they submit their applications.

1-you’re a national of a country outside the European Economic Area
2- you’re applying for a visa to work, study or join your family in the UK for more than 6 months (but you’re not applying to remain in the UK permanently) doesn't this mean in other words settlement which is my case.?

You've misunderstood. 'not applying to remain in the UK permanently' means 'you're not applying for Indefinite Leave to Remain. Which you're not.
The NHS surcharge will have to be paid for each dependent.

Thanks for clarification.

I have Short tenancy agreement for next 6 months. Will that suffice for Sponsor accomodation requirement for family settlement visa ?

On financial siutation - I am self employed and with my PAYE salary and Dividend I qualify for salary requirement of approx 25000 p.a However I will be completing 1 year end of April as self employed. So not sure I need to show Profit/Loss statement of my Limited company or my personal earnings.

Please advise.

I have family settlement visa booked from India on 12May. I am permanent resident in UK. I have quick query on Appendix 2 VAF4A Financial requirement form-

-- my spouse is applying for entry clearance with 2 children as Dependants - Do children need to fill this Appendix 2 ?
-- I meeting financial requirement as sponsor for my family (spouse and 2 kids) under section 3C category F.
Do I need to fill section 4 OR my children need to fill section ? Please help.
-- Do I need to fill in 1.27 and 1.28 ? Am I required to fill in details of my family in India who I am responsible for and the amount in INR which is required to support each month.Is this to prove subsistence ?

I would appreciate your prompt response as I am supposed to send this documents to family for their visa appointment in India.

Hello experts,

I urgently need your help on query concerning English Language assessment for my spouse applying for settlement visa. I am planning to submit -
- Degree certificate + Mark sheets
- University letter stating that degree was taught in English.
- NARIC - statement of comparability. ... Is this ok ?

My question is - Do I NARIC Statement of comparability OR English Language assessment ?

Please advise.
