Child born while father on T1G

Hi,

My daughter was born when I was on T1G and now I have ILR. She was born in UK and have been in UK since. I am wondering if she can apply for Passport directly or she will need to be my dependent at this stage?

As your child was born before you had settled status you cannot shoot for a passport directly.
You need to register your child as a UK citizen under section 1(3) of BNA; (use form MN1).

Once child has been registered you can apply, separately, for a first British passport for her.

What would be the case for my daughter if I wait for my passport (due end 16)?

Do I still need to register her before applying for passport?

The same.
She was born before you were settled or British.
Your citizenship (if/when you naturalise) cannot be 'inherited' by her in any way.

btw - you need to naturalise first; British passport stage comes later - by separate application.

As your child was born before you had settled status you cannot shoot for a passport for her directly.
You need to register your child as a UK citizen under section 1(3) of BNA; (use form MN1).

Once child has been registered you can apply, separately, for a first British passport for her.

And if you had applied for MN1 when you originally asked in Sept 2015, she would have been British and likely had her passport by now and avoided the fee increase that happened in March.

She was born before you were settled or British.

What (British or foreign) passport did you what to wait for and why?

Vinny, OP appears to believe his next step from ILR is a (British) passport sometime in late (20)16.

That is assuming (as this post is all about getting British passports) that "my" = British.

There is no confusion between naturalisation, registration and passport applications.

My daughter was born in UK (Sep 14) when I was on T1G and since there were no travel plans etc, I didn't bother to apply for her registration etc. In Nov 15, I got my ILR.

Now a thought crossed my mind that (may be), registration process could be exempt for a child to an individual like me who has obtained ILR esp for Child who is born in UK.

Now the registration process seems redundant.

No, you/child is not exempt. You still need to register your daughter as British on form MN1 first and this could only be done after you got ILR anyway. You obtaining ILR or BC does not change the fact. Your daughter is NOT British so cannot apply for a passport directly.

The process is not redundant as the child is NOT British.

Think about it, it would be bizarre indeed if a child was British and parents were not even settled in the country and then happened to leave to try their luck in some other country. (As does happen).

Your child doesn't suddenly become British just because you now have, years after she was born.
However, fortunately for her, she is entitled to register, now that at least one parent has potentially committed to UK with ILR (and possibly citizenship).

Then and only then, when registered, can the final step of applying for the child's British passport be taken.
