Work Permit based Entry Clearence rejected.. Please Help !!!

Post by Jimmy.saji » Sat Jan 19, 2008 8:10 am

Hey friends....

I am based in New Delhi, India. Last year november I was offered a job in U.K and the company has applied for my work- permit. I was successful in getting the work-permit.
But in December when I applied for the EC in New Delhi, the EC officer has rejected my application- mentioning that one of my employment documents were false.
Now I did work for the specific company but few of the matter mentioned in the employment doc were not correct- which I agree. All this happened because I was mis-guided and adviced by one un-proffessional Visa expert.
I have got a fresh employment doc from the same employer. Request somebody to please advice as to how should I re-apply and what would be the outcome after I re-apply.
Also what other documents should I submit and are there any chances of any positive outcome.....SOMEBODY PLEASE HELP!!!!!!!!!!!!!!!

Would you be able to post the actual wording of the refusal notice (omitting any names of course).

If you used the same falsified document to get the job and/or the work permit, I wonder whether these also may be revoked. Have they?

The main para for the refusal reason goes like ths-

In support of this application you have submitted a letter from ******* from***** dated******. As a result of checks made by this office I am not satisfied on the balance of probabilities that this is a genuine document. Your application therefore falls to be refused in addition under paragraph 320(21) Wheather or not to the applicants knowledge, the submission of a false document in support of an application.

I also submitted the same document for the work-permit application. I had different interviews with the employer and was successful in getting the job.
But my employer and my employment with the company is genuine. I had worked there for the same duration mentioned, just that one or two lines about the profile of the company mentioned in the letter were actually not matching with the actual one. It all happened because of wrong guidance from the Visa expert.
The HighCom has provided me with a Right to appeal doc.... but will I have a positive outcome. The employer in U.K is ready to help me, as they have made thier checks regarding the employer in INDIA.
PLEASE HELP!!!!

About 97% of the employment letter contents are true to the best of my knowledge, as told before few lines about the profile of the comp differs.
I am not much clear if they have revoked my work-permit, because there was nothing mentioned in the refusal letters or any other communication from the HighComm

If you appeal, it will take some time, and under the para that was quoted in the refusal notice, it's a perfectly straightforward refusal, you submitted a falsified document. Given that you supplied the same document to get the work permit, I find it hard to see how such an appeal could succeed.

The alternatives are to ask for a reconsideration of the existing application based on a genuine employer's letter, or submit a fresh application. But in either case logic suggests that the ECO would want to establish from Work Permits UK whether they still considered that their issue of a work permit was valid. I can't seem to access the relevant Procedures on the UKVisas website at the moment to see what the guidance is in such cases, and the work permit casework instructions on the BIA website don't seem to say anything about revoking WPs, so it's hard to be definitive.
You might need to get your UK employers to ask WPUK to confirm that based on revised info the WP is still valid, and proceed from there.

It's a cautionary tale, isn't it? - that taking advice from "unprofessional visa experts" or the companies that advertise "100% success" or "visa guaranteed" who then advise you to lie or submit false documents, is not a good idea.

hey thanks for the info......

If my work-permit is not revoked, are chances that if I provide my application for re-consideration... will there be a positive outcome.
Also how do students apply for a one year work-permit after the end of their course, because I am also a U.K student and would be graduating this year. Do I need to pay during the application of such work-permits.
