Query on Tier 2 ICT after 5 years

Could not find a related thread and hence created this one.

I am in UK since 4 years on Tier 2 ICT and my spouse is a Tier 2 ICT dependant working as well since 4 years.
Once I complete 5 years, is it possible :

1. For my spouse to apply for Tier 2 ICT straight away ( without serving cool off ) provided her company is ready.
2. Can I become dependant of my spouse straight away ? Or do I need to serve a cool off period.
3. How long then I have to wait as a dependant before I can reapply for my own Tier 2 ICT ?

You don't have to wait till you complete 5 years. Why would you think this?

1. For my spouse to apply for Tier 2 ICT straight away ( without serving cool off ) provided her company is ready.

She can't apply for ICT visa if she is working in the UK for a company. It is Tier 2 General she has to apply for and has to apply from home country. Sponsor will have to complete the full and proper RLMT process to prove to HO that she has not been 'pre-selected', which is quite difficult if she has a number of years already working for them. For info, ICT visa can only be applied if you have been working in your home country for the sponsor for a minimum of 12 months. Cooling off period DOES NOT apply to dependents changing to Tier 2 main visa holder.

2. Can I become dependant of my spouse straight away ? Or do I need to serve a cool off period.

Yes, no serving off period applies and you could switch within the UK once she is successful with Tier 2 G from home country. You must apply before your ICT visa expires.

3. Ho long then I have to wait as a dependant before I can reapply for my own Tier 2 ICT ?

12 months from day of dependent visa issue. Again, you cannot apply for ICT in these circumstances. It is Tier 2 General, from home country.
