Tier 2 extension after TUPE

Hi there,

I was wondering if you could advice me on my current situation.

I got my tier 2 visa for 4 years back in Nov 2011. My visa is valid until 18th Nov 2015.

However, my company which is a train operating company was taken over by another franchisee in April this year and I was TUPE'd over to the new company.

The new company notified the UKBA that they'll take ownership of my visa, applied for a sponsor license (which they got in Aug this year) and are now looking to issue me with a new CoS.

My HR manager has just notified me that they still didn't have any acknowledgement from the UKBA regarding my TUPE transfer. The Home office has requested additional documents etc from my company so looks like they are looking into it.

My question is if my company issues me with a new CoS, should I make my application or wait for the Home office to acknowledge me TUPE transfer ? Do they usually send out a letter to the visa holder as well ?

Can i know if your application went through smoothly with the UKBA? And how long did it take for them to give you a reply?

The user only ever made one post in 2015. Suggest start your own topic with your circumstances and question rather than digging up old threads.

p.s. It is UKVI and not UKBA anymore.
